I now reconvene to the regular meeting of the Board of Education at 7:01 with Cruz not Orozco and Fikes present before we begin please silence all electronic devices and note that these proceedings are being recorded pass the bit the Board met in closed session from 5:00 p.m. to 6:30 4:00 p.m. regarding conference with legal counsel existing and anticipated litigation a student

expulsion matter public employee discipline dismissal release public employee appointment High School assistant principal and coordinator teacher support and conference with labor negotiators a CT and CSC a the board voted to appoint an Austin Andrade assistant principal Chino Hills High School effective November 2nd 2018 by the following vote Cruz Blair not Orosco and bikes voting yes and voted to a

point Teresa Shockley coordinator teacher support effective November 1 2018 by the following vote Cruz Blair naw Orosco and bikes voting yes and by the following vote the district decided the matter of an appeal of a complaint filed by employee number two nine eight two voting YES mrs. Hernandez Blair mr. Nam mrs. Orozco mrs. Pike's voting no mr. Cruz and by the following vote the

good evening board president Fikes esteemed board members dr. Ann field superintendent and superintendents cabinet my name is Tom Rummel and I'm the fortunate and very proud principal of Wichmann elementary school and it is my pleasure to introduce to you mrs. Sheryl Lane and mrs. Allie Scranton two of our outstanding leadership teachers at Whitman elementary school mrs. amber Portello our third leadership

teacher was not able to attend this evening for the past 15 years which is pretty incredible when you're thinking about an elementary leadership program we have had our leadership program grow under the direction of these three well these two teachers and the one that is absent tonight and these teachers have given our fourth fifth and sixth grade Wakeman Wildcats the

opportunity to lead and make a positive difference in the lives of others this has really empowered them to go out and do community service projects at this time I would like to have mrs. Scranton and mrs. Lane tell you a little bit more about the program and then introduce a few of our exceptional students Sheryl Lane thank you so much for this

opportunity to showcase our students we're very proud of all of their hard work part of our process or leadership application process is they have to do a service project in the community it can't be something at school it has to be reaching out to our community they have to come up with a project and share it with all of our kids that are

applying for leadership so we had amazing group of students this year and we're really really proud of the that they've done so when mr. Rummel had asked if we would bring a few kids here to share with you guys we thought how awesome because we get to see about we had I think 88 applicants this year so

we get to see all these service projects that the kids go out and do so this is just a little tiny snippet of what they do and so we have a few kids here to share today so first we have Mika oboz' and Caitlin SRAM and they're both sixth graders at Wichmann and they're gonna share their would you please help them

adjust the microphones so let's see thank you hi my name is Mika Obata and my name is Caitlin Tran and today we'll be talking about the teacher survival kit school season has come back for another year and some schools have just started for the next ten months they will continue to follow the same process daily assigning homework helping kids

with testing and so much more luckily for us teachers continue to teach knowledge to generations of students we hold our church at Chappell elementary and we want to return the favor by preparing these teachers for the year they have ahead of them to do that we may teach your survival kits being a teacher isn't always easy it does sacrifice that is made by people

who truly want to spend time with kids no matter how hard it is the teacher survival kit is basically a box filled with the necessary items to survive the 2018 to 2019 school year at Shaffer Elementary there are 60 members of the staff and we don't want to leave any of them out so we made sixty teacher

survival kits in two days these supplies can be helpful in various ways I'm so happy to be here helping all these patient and hard-working teachers while they play inside these boxes were key for soothing Hershey's chocolate for a nice appreciation treat mints for a refreshment and advil from some disobedient students other things we put inside the box were hand

sanitizer tissues band-aid and lip balm sometimes when they are necessary on top of the teacher survival kit we will put a little card with ink or something encouraging on top of it for example good for our job for being a teacher thank you for doing what we do you do oh we would draw and then we would draw a

cup of drawing to accompany of the writing leadership is serving others and for this project we chose to serve others by helping teachers with giving teachers these survival kits foreign head start we love our teachers received one which was very nice and we do not you know pay them to say that that was their project on their own and they did an amazing job

we have julia herbs to share her project hello i am julia herbs and my service project is called sing for joy before i tell you about what i did i'd like to tell you an inspiring poem by you and tate all we are we have found in song for this is music's inner voice yes we hear you all those who cry aloud when

you'll fly answering you so our lives sing sing we will fly a wild and spirit we will fly like a feather falling from the wing fragile was a human voice afraid uncertain alive to love we sing his love afraid uncertain yet our flight begins as song one month ago my grandparents couldn't walk so to give up their home home and move into a seniors

home and they were really unhappy I wondered what could I do I'm just a nine-year-old kid but then I had an idea I can sing really well and my mom's a voice teacher so I might sing for them at Valencia Terrace I told my idea to my mom and she thought it was great she called her students and they agreed to

sing first we rehearsed with a pianist and then we went over and saying I sang and I know things now from into the woods saying buy a Little Red Riding Hood and my mom and I sang a duet anything you can do I can do better from the Broadway musical and you your gun after we sang everyone was really happy

my grandparents were really proud there is a youtube links at the bottom of my poster board if you want to hear me sing and the seniors however have already invited us back that was my service project I hope you enjoyed it thank you Julia and next we have Elle Scranton and writer Scranton a sixth grader and a fourth grader at Whitman

hello I'm good evening my name is Ella Scranton and my name is Ryder screen today we are going to talk to you about our leadership project my kindness key unlocking kindness won cutest we decided to do this project because he liked the idea of paying it forward I really just wanted to spread kindness he brings strong ideas of what I don't need to

pass out just to show you you've done a good deed we decided on a key with the word kind on a necklace so we set out on a quest to find keys people donated old keys we painted them turquoise and we tried to stamp them with a metal stamping die but the keys were too thick to punch so we

went back to the drawing board and we found different keys at a local craft store we started the process of stamping the word kind into the keys this is a hard process because you have to stamp each letter separately and make sure the letters are inside the correct spots each key is unique in its own way we

then needed to figure out how we want our packages to look Ella and I went on the computer and designed a kindness card we then found little baggies that fit both the key and the card to get the campaign started we gave keys to teachers friends and family to some new exciting things have been happening since this campaign started we started

an Instagram page called my kindness key and had everyone tagged hashtag my kindness key people have contacted us from other school districts and even other states they have seen our campaign through social media some high schools have reached out to us and asked us to send them some keys has started at their site a Girl Scout Troop in Maui a school

in Florida a high school in Montclair and a school in Diamond Bar a school and a Girl Scout troop in Mission Viejo and several other schools in the Chino Valley Unified School District tonight we brought a key for each of you we hope you guys will spread will help us spread more kindness keep spreading kindness one key at a time keep calm and be kind

so while they're passing out those keys you can't understand why I am so proud and so very fortunate to be a principal at Whitman elementary school with these great teachers and these great students and we have eight hundred and something more students that are just just as fun so thank you so much for allowing us to present tonight and let's give our

teachers and our students another round of applause before you depart some board members have comments mister not like to thank mr. Roemer and Carranza and teachers when I had visited a few months ago it was all about teaching our kids about respect and I watched them all the the taller ones two little ones sitting down in the

quad learning and practicing kindness and and serving others and and makes me so happy I'll tell you the truth I'm so proud of you our little ones because I think you guys submit may be better than our college students today or even adults ourselves so thank you for for your blessing for our community because you are truly blessing for all of us and

I like to thank the parents how could we have the parents stand up please parents here thank you let's give them like big hands for raising good care at home thank you so I have a nice day and and whatever you need with support like that we need to get involved as a district thank you thank you teachers

thank you mrs. Orozco what a great presentation you all did so well-spoken I mean I am just blown away by how well spoken you are the projects that you selected you did an excellent excellent job so proud of you and but it's absolutely a reflection of your teachers and so thank you to the staff who helped the

students shined as they did tonight mr. Cruz and also you know as you were completing this project how did it make you feel inside you know the feeling of being personal response is there anybody would like to share the feeling that that you you received by giving back all done thank you so so to kind of piggyback on what mr. Cruz is saying I

think you'll long remember this I know we will thank you so much for sharing tonight thank you our student our student representative Alexei Marianas is receiving an award tonight from Senator Connie Leiva so she's not in attendance that brings us to comments from employee representatives someone from CSE a no comments all right if it Farley chant present president Oh Tom Tom are you the

new president is a different okay she told me into doing this tonight so anyway I'm Tom Mackin see I'm the president-elect for champ and good evening president vice Board guests and I just have a couple of things to say first of all can you believe it we're more than one-fourth into the way through the school year I

just figured that out tonight so there's going to be a speaker event hosted by champ at the PDC to Wednesday November 7th from 4:30 to 6:30 p.m. two of our very own will be presenting Todd Finkbeiner principal of Kenyan Hills junior high will be speaking about every story which is a way to connect students to their school and Molly large

principal of Rhodes elementary will be helping everyone to incorporate social media to brand your schools to increase positive school climate so and secondly I'd like to champ would like to thank all the principals and administrators for really pushing and trying to encourage parents to take the parent survey through emails grade level competitions personal daily communication in whatever

ways that they can figure out to do and if you haven't taken it yet you can still do it so please do that that helps our district really get some direction of where to go and it really really does do a good job we also had a PLC training today I went to a PLC trainee today and it was great Jenelle

Keaton has been working with teachers and administrators from every school I think this week on rebooting our PLC which is professional learning communities the focus of her work is with us is every school every team every classroom champ wants to thank a CT and dr. Enfield and his staff were partnering together to bring this to Chino Valley with all staff classified

certificated and administration working together we could really become unstoppable and I think and help every student reach their potential so that's we're excited about that just a reminder for everybody as we get closer to elections our district model humility civility and service is even more important to keep in mind our students are watching us and it is

through our actions that we show them how to behave so we want to keep that in mind and finally I may not be have a chance to be at the podium again before the reorganization in December so on behalf of champ and myself personally I would like to thank mrs. bikes and mrs. Orozco for all their service to the

Chino Valley throughout the years and you guys have done such a great job and we really appreciate all you've done for us over the years and we hoped best for you and all your future endeavors so thank you on behalf of Jim thank you Brenda Walker okay community liaisons we're now at community liaisons presenters serving as community liaison

should limit their comments to matters relating to their community agencies if you would like to comment on agenda items or non agenda items that are of general interest we would appreciate it if you would complete a speaker card as all of the community members do no one from the city of Chino Hills no one from the city of Chino are you from the city

of Chino okay so a few months ago I was here and I've had about a month on the job I was sworn in on September 18th to the community services commission for the city of Chino so I thought I would come to let you guys know I've you know I got him through the month and I also

have a few announcements on a few events then not only all of you are welcome to attend to but all of our community members this Saturday for ages our children 3 and up there will be carving pumpkins at the Chino community garden from 9:30 a.m. to 11:00 a.m. it's bring your own pumpkin and you do have to

register on healthy Chino eventbrite.com we'll also be taking registration to receive holiday basket for Thanksgiving our Christmas meals and holiday gifts for youth children it is free to children who live in this in Chino and whose parents meet the registration requirements registration will be taken at the neck at the neighborhood activity center on Saturday October 20th from 9

a.m. to 12 p.m. and Tuesday October 23rd from 9 a.m. to 2 p.m. for our seniors we will be having a spooky senior dance you must you got a rare costume we're gonna have music light refreshments it's free Wednesday October 24th at the Senior Center from 2:00 to 4:00 p.m. you'll also have the lights on after school

event which I'm sure you all are aware up on October 25th on 4 to 6 p.m. this year our Halloween spooktacular it will be at a new location it will actually be out a yellow Park from 4 to 8 p.m. and the first 1,000 kids receive a Halloween bag on the first Friday of the month is every month if we're looking into

November on November 2nd that you know youth museum poses their first Friday of the month it's great for toddlers highly recommend it they can burn out some energy it's from 3 to 5 p.m. and then lastly on Saturday November 3rd we have park around the park at a yellow park owners are required to fill out a waiver and you

can do it online or you could do it at 8:30 a.m. before the event starts it'll be either yellow Park from 9 a.m. to 12 p.m. and that's all thank you thank you great someone from the fire board know someone from superintendent hangman's office supervisor hagman's office no all right then we are now at comments from the audience on items not on the agenda

h-how'd are there any requests to speak on non-agenda items requests to speak three speakers you will be called in the order the requesters received please listen for your name and be prepared to approach the podium any comments on agenda items will be accepted during consideration of that item once the board has commenced deliberations on an issue speaker cards will not be accepted

the board is very interested in your comments but please bear in mind that the board typically does not respond to comments during this time on the agenda as it is reserved specifically for public comments individual members may respond during board comments at the end additionally the board does its best to support the public's right to address its elected officials it is also

important that the board conduct its business in an orderly and fair fashion as provided in board by lon 93 23 in the event that an unusual amount of speaker cards are submitted for any item the board will hear up to 30 minutes of comments in the case of non agenda items the board can if it chooses for the remainder of comments

after all business has been conducted mrs. Blair is not here to explain the light system speakers will have three minutes in which to make your comments please begin your comments at the green light the yellow light indicates you have 30 seconds in which to complete your comments the red light indicates your time is over and before you begin

your comments please adjust the microphone as necessary so that you can be clearly heard and audience members please refrain from making comments while speakers are at the podium speakers please remember that in accordance with board bylaw 93 23 bylaws of the board meeting conduct limit remarks to three minutes total for all remarks and please limit remarks to me points the board

would like to remind you that board policy thirteen twelve point one contains the procedure for anyone who wishes to file a complaint against the district employee please follow that procedure the first speaker is Maya Cortez followed by Kelly McCluster followed by Peter Atwood good evening members and guests my name is Maya Cortes and I am a senior at Donegal high

school I do not believe Andrews is fulfilling his duties as a school board member and your crews we have constantly badmouth the LGBTQ community and validating their issues yet backed up your own claims with only religious believes on your suit of science articles you have brought up your church's believes during these meetings where you're supposed to be overseeing

the education of all students CP USD is filled with diversity the line between the separation of church and state has been blurred and the position you are in you have the responsibility to represent a public voice on what the citizens want not make others feel inferior I am one of the many students have voiced their concerns about the inappropriate things

you say you are not showing the correct vision or setting the correct goal for our school we are taught from a very early age how to treat others fairly in and out of the classroom we are taught that hate is a very strong word that shouldn't be used lightly you expressed hate in your rants feeding off the

attention and reactions you receive which brings me to the question is that why you haven't resigned you use untrustworthy articles to back up claims endorsed by your religious beliefs and directed analogies about Nazis without having a second thought of who your audience is mr. Cruz we the students from this district are your audience you are supposed to be setting our

educational direction and the only direction you are taking us is a direction of hateful racist sexist homophobic people and I'm not speaking to you as a student of CP USD nor as a supporter of LGBTQ rights but as a person with the more sense of right and wrong and your crews the school district deserves better representation and I'd like to remind

you that the students do not have the responsibility to remind you on how to act but if we need to we will thank you for your time the Education Code requires that each year the Board of Education shall elect a president from its members it does not require a rotational model by which board members are entitled to become

president without a majority vote of the board currently the CV USD board employs a rotational model and not a majority vote model by which each of its board members cast his vote for president at some point if the rotational model is allowed to continue mr. Cruz will become president allowing this to occur will be detrimental to meeting efficiency it

will cause division in the community and it will increase the likelihood of the district being subject to lawsuits not all members of the board are suited to preside over a school board specifically mr. Cruz is unfit for duty as a board member let alone the president mr. Cruz is unable to effectively communicate his thoughts to those around him as

evidenced by his official statements and subsequent apologies mr. Cruz is unable to convey his thoughts without offending single parents the LGBTQ community views or people of color when opposing the district sexual education curriculum he suggested that the district should willingly break the law this clearly contradicts mr. Cruz's oath to follow the law and uphold the Constitution mr.

Cruz has a proven history of offending others and does not deserve to be in the leadership role mr. Cruz has poor time management and organizational skills he has used meeting time to ramble about his own personal agendas from toxic rain water to his views of non-existence of racism this rambling caused the public to sit captive while an unfit elected

official made statements unrelated to official business board presidents must be able to implement parliamentary procedure to efficiently lead public meetings as a past president mr. Cruz was unable to preside over meetings without repeatedly asking for direction on how to proceed this inadequacy and clear lack of experience disrupted the movement of discussions and board decisions it unduly extended the time required to

effectively govern and was ultimately a detriment to the efficient use of time in summary all of mr. Cruz's communication deficits his poor time management and organizational skills his lack of technical knowledge and his divisive behaviors have consequences to the community and to the students by allowing the rotational model of board organization to continue mr. Cruz will eventually occupy the president position

if this occurs the district will increase the likelihood that mr. Cruz will again miss speak and interfere with effective governance this is intolerable as it will lead to continued public ridicule and will likely increase cost associated to defending lawsuits leadership starts from the top and poor leadership will trickle down to the district's employees and students I urge

the board to consider transitioning from the rotational model to the majority vote model thank you exactly that's right the problem I'm raising in a Verizon with you all through email and whatnot is the Raptor technology sign-in system which the board is boy and also we told people that in fact their their information is not compromised I have put in a Public Records Act

request for things everything related to this and like a like a play at throwing chaff to of a way to heat-seeking missile all kinds of nonsense has been thrown back at me but one thing that the district is not produced it's a raptor subscription agreement which a couple of other districts have produced and so I have it here there's a couple of items

in here or Venice paragraph four says regarding data collection subscriber acknowledges and the subscribed as a district and agrees that Raptor shall have the right but not the obligation to collect data and information related to subscribers use of the subscription services which is the signing in two different schools factors shall be free to use such data and information and may disclose such

data and information in an aggregated depersonalized manner that does not disclose the identity of subscriber or any person associated with subscriber course if you're not associated with subscriber like me that doesn't apply collection handling and use of personal information of an individual shall be pursuant to and in compliance with the terms of the venn current raptor privacy

policy provided on the rafter website in other words they'll do this in accordance with whatever they want to do and I'm reminded of Darth Vader in the Empire Strikes Back I am altering the terms of the deal pray that I do not alter it further indeed it begins by saying that your when you sign this agreement you're just

agreeing to whatever they said well of course data breaches do occur you've given raptor permission to gather people's information do with it whatever they want to including data mining and whatnot the district is lied to people saying that none of this is happening you've refused to produce the agreement energy response to a Public Records Act request and you think that that could get Raptor

into trouble if somebody steals the data or otherwise does something to it is they've done you know it's at a National Security Agency whatnot Rock your took your this problem they have an indemnification clause that says that the district will reimburse indemnified defend and hold harmless a raptor for anything that happens which in other words means if somebody Sue's raptor for

mishandling their data they get to send you the bill regardless of the merits let me borrow those who whose fault and what so at this point I think that you ought to it seems obvious that nobody really read this before signing it I think it would be appropriate to coop up to the public disagreement and it would

be appropriate to stop collecting information until we are now if changes and deletions patter there any changes or deletions the following deletions are on the agenda item 5a one this item is pulled from the agenda thank you we are now at the action item please announce the item item 2a one public notice and hearing regarding the district's initial

may have a motion so moved second second all in favor aye aye opposed the motion passes of the vote of four oh so mrs. Orozco item 3b to page 17 so what I'm going to request is that we because this is a block of items within the one item and so what I want to do is for page 17

3 b2 is full specifically Chino Hills High School general boosters and then vote on the other Ramon Arjun high so okay - so all in favor so moved second okay just on the poll all right so so moved by mrs. Orozco and seconded by mr. na all in favor aye opposed passes 400 can we take the chino hills' boosters

and then the other item because it's a chair holds boosters and then she knows bingo I'd like to discuss those together so we're gonna come back to the -1 yes okay so now we're looking at 3b 3 correct page 21 okay took them both at the same time last time so let's finish your discussion on the tuna Hills High School

general boosters where did you do one last time I'm so we did both we did the other one first last night you did it first but not at the same time okay okay so I'm okay with approving the boosters the general boosters but I have an issue with the fund raising event and so what I want to do is go ahead and

approve the general boosters but I'm going to asked for a provisional approval on the event that they host that there's a fundraising event so so then it's not necessary to hold off on approving this particular I just wanted to make sure that the board members didn't have an issue with once I talked about the event okay any other mystery the question

there was issues with the auditor know there's there's issues that are continuing and so I'm gonna so you'll address that at the next section so at this point we need to vote on approving yeah this so do I need another motion yes retract the first vote reconsider that and then just do it all together there's look there's nothing different

between Ramona junior high school you know classical crash so you can reconsider the boat so it's just one vote okay so do we need to motion the reconsideration I move to reconsider second all in favor aye aye so now we're just voting on the item the one as a whole okay all in favor so move second all in

Orozco so move second so this is oh I'm sorry we need to pull the bingo specifically don't I so you motion was Orosco James now second to specifically we pulled the bingo under Chino Hills High School correct when it's combined like this it just makes it a little bit more okay so this

way that we can approve all the others as is oh I see alright so all in favor of do we need all in favor of pulling the bingo you can look at everything except the exception of okay we're voting in favor of approving everything with the exception of the chin a high school bingo all in favor aye opposed

now on the bingo you want to discuss so on the bingo in order to discuss I'm so moved second okay so there are it appears that there are continuing issues with bingo and I'm gonna provide staff the information that I have obtained so I would again like for the board to consider to approve it on a provisional

basis given that we're right around the holidays I would assume probably January at the January meeting so let me just I'm gonna read some co-ed code a LeFort actually California Penal Code so a bingo game shall be operated and staff only by members of the authorized or organization that organized it those members shall not receive a profit wage

or salary from any bingo game only the organization authorized to conduct a bingo game shall operate such a game or participate in the promotion supervision or any other phase of the bingo game this subdivision does not preclude the employment of security personnel who are not members of the authorized organization at a bingo game by the organization conducting the game so the

main point is you know there's a subdivision any individual corporation partnership or other legal entity except the organization authorized to conduct you know that game shall not hold the financial interest in the conduct of a bingo game in our booster handbook it indicates cooperative fundraising occurs when individuals receive credit for funds raised individual fundraising accounts are used to keep record of credits to an

individual student or parent for funds raised you cannot do that it goes on further to say the IRS has indicated that use of cooperative fundraising and individual fundraising accounts may disqualify in nonprofit organizations tax-exempt status I want to ensure that that doesn't happen and so I'm going to provide you with some additional information so that we assure that

that's not happening so I would ask the board to provisionally approving till January January 17th is the next day January 17th then okay okay so all in favor aye opposed so it is a provisional approval for the chino hills' general boosters weekly bingo until january 7th 17th for 2019 we are now at information items are there any questions or comments Phil

Cruz yes I attended the 12th annual Music in motion

and it was amazing program the Booster Club is amazing and orchestrating this event it was a fantastic showing you know I found out that IKEA s'en he actually coordinates the all the Dan showcase I didn't hear that I like Jackson just phenomenal stuff so thank you I said it yeah okay mr. not yes you have attended football games and I had

lots of fun with all of our high school kids and I couldn't decide what high school to support because I love them all I just wish that no one gets hurt in football games and like the emotions like being it together it's awesome we have a set news from Chino Hills High School where we had last student it

breaks my heart yes life goes on they say especially our youth when we lose them for any occasions where did it's a disease or an accident or what anything really breaks our hearts so my prayers are with the family yes Raptor program Thank You mr. pure ed would you bring out important issues all the time I like to ask and if the right

many people are aware of it but I believe it all of our schools we had drills today it's a huge effort by administrators and teachers and classified staff and our students so I appreciate that we can never really be prepared for an emergency but participating in drills like this are a step towards handling the eventual emergencies in a better way so I thank
