all right good evening everyone thank you for being here it is six o'clock so i now reconvene to the regular meeting of the board of education thursday march 18th at 6 pm with bridge cruz gagne naw and schaefer present in the board room the meeting is being live streamed on the youtube channel for the chino valley unified school district
miss pat thank you pat leading us in the pledge tonight we'll be mr bridge your hand over your heart ready begin i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god an individual with liberty and justice for all president shaffer may i say something
real quick uh sure you know my heart is being stirred up and um you know this san diego um you know superior court judge freeland um stated that temporarily they temporarily blocked the um framework of 2021 of violating um children and the framework is depriving those same children of a fundamental benefit of education and she states their liberty
their property the process of their constitution and the reason why i'm bringing this up is that you know there's there's there's girls that want to play they want to cheer they want to do all this all this wonderful stuff it just bothers me that you know they're being emotionally affected and knowing what the judge has done is to remove all this framework from the
2021 i think i think as board members we should um grant them the opportunity so they could go ahead and um have fun at the football practice mr cruz if i could please this is not an agendaized item so these are probably more pertinent in your public your comments at the end so we'll move on now to presentation
california voting rights act next up is a presentation regarding the california voting rights act which is presented by todd robbins attorney for atkinson anderson loya rudd and romo mr robbins thank you for being here this evening the floor is piece of legislation as a way to possibly solve that outcome so a violation of this california voting rights act is shown
where there's evidence of racially polarized voting the easiest way to understand racially polarized voting is if there are two candidates candidate a and candidate b if an overwhelming majority of the non-minority community in in the jurisdiction votes for candidate a and an overwhelming majority of the minority community in the jurisdiction votes for candidate b that could be evidence of racially
polarized voting if the statistical data shows that the voters preference um was correlated to their the the race of the voters and and there are statisticians that that do um an analysis of that uh and ultimately it becomes a battle of experts if the issue is litigated but the thing that's important to remember is is you've received a demand
letter but this is not um an indictment of any of the board members sitting on the dice this is not somebody saying that the five of you are using an at-large election method to suppress the rights of individuals there's no intent that the plaintiffs need to show in order to show a violation of the voting rights act it's simply
statistical data that will show whether a voting rights act violation occurs or not so what's the process under the california voting rights act a plaintiff must send notice to the local agency asserting that their election method may violate the california voting rights act you've received that demand letter no later than 45 days after receiving the notice you need to
pass a resolution of intent to transition and describe what steps will be taken the board did that at its last board meeting so you're already two steps into the process now that the resolution is passed um no other plaintiff can file a demand with you or initiate litigation for the next 90 days so we have 90 days to
complete the process um once we're done with the process the prospective plaintiff who sent the demand letter can file a demand with the district demanding up to thirty thousand dollars in attorneys fees and costs for their efforts in preparing for the potential litigation so i'm skipping that last slide because it's basically redundant so what is the transition process so now
that the board has passed the resolution of intent what are the steps that the board needs to take first the board is going to ultimately need to pass a resolution that's going to be the end result after the public has an opportunity to provide input not only on what the maps should look like when we draw them but then once the maps are
drawn whether any changes should be made to the maps as well so you're going to pass a resolution the education code provides for three ways to start the process but the third way that's bolded there is the most common way to initiate the process recent amendments to the california voting rights act into the elections code have added some
additional steps similar to the claims prison presentation step that you have as a government entity so before i'm sorry and that that deals with the demand letter but with respect to community input before you can draw a map the board must conduct at least two public hearings where it seeks input from the community on what the map should look like
potentially what election cycles should the board consider whether there are any natural boundaries that the board should consider any man-made boundaries the board should consider and the board should take all that information share it with the demographer and after the second public hearing the demographer can prepare some conceptual trusty area maps on those maps the the demographer will
need to show what the district looks like when it's divided up into five trustee areas the trusty areas have to be divided up as equal in population as possible so let's say there were 100 000 residents babies to senior citizens in the chino valley unified school district a hundred thousand divided by five is twenty thousand so each trustee area
would need to be as close to twenty thousand people as possible um there's a variance under federal law of up to 10 that we can have so give or take about 2 000 people between the largest and the smallest uh population trustee area when we do this in addition to those trustee area uh boundaries and population numbers
we're also going to need to show what the sequence of election is so there are some of you who will be up for election in 2022 and some of you who will be up for election in 2024 and we will need to show what impacts those election dates may have on filling potentially vacant trustee areas which means areas
in which no trust no board members currently reside so that information will be on the maps as well once those maps are published there would need to be at least two additional public hearings at board meetings over a 45-day period to gather input on those proposed maps and the proposed election sequencing and if the board receives information at any
of those meetings where they decide that certain revisions to the maps need to be made those revised maps need to be published for seven days at least before the board can take action to adopt one of those maps once published after the initial public hearing process the maps this is a good practice can be posted on your website for review and comment 20
24 hours a day seven days a week that's a that's a common practice among school districts that have gone through this process another option the board has for seeking community input and this is a little more challenging during the pandemic but to the extent we are able to start gathering in person again the board may decide that it wants to hold community
meetings at locations within the district and if we did that during these these pandemic conditions we'd obviously want to make sure that social distancing protocols are met and things like that but it is an option for the board if they wanted to seek additional in-person community input once we've gone through the public hearing process and any maps are adopted the district's
ultimately going to adopt a trustee area election map so you're going to have two to three maps that you're that you're reviewing and the board will ultimately vote and pick one also the board will adopt a resolution formally transitioning from at large to buy trustee area elections and inviting the san bernardino county committee on school district organization
to come into the chino valley unified school district hold a hearing and give its approval to your process as well they have to hold at least one public hearing in my experience they will hold only one public hearing in your boundaries and at that meeting the superintendent and any other stakeholders involved can provide information to the county committee on the process that the
district undertook the county committee will consider that and they will vote to approve the process and within their resolution the education code has a default where the county committee calls for an election on whether the chino valley unified school district should transition to buy trustee area elections that's the default process that election if it were to take place
which we're going to talk about in just a minute would happen in november of 2021 if we were able to get that election on board on time but this election proce this election question remember it's limited only to should the district transition it has some some risks involved some substantial risks and so here's the question that would be
on the ballot and this is straight from the education code education code section 5020 for the establishment of trustee areas in the district yes or no is basically what the voters would be voting on what if the voters vote no if the voters vote no and reject the transition unfortunately the school district would still be liable under the california
voting rights act and so the plaintiff who sent the demand letter um could initiate litigation against the school district even if the community voted no on the issue that is not a defense under the california voting rights act so there's substantial liability uh involved if a if the election results in a note and i will tell you
is we're going to talk about the the process regarding a waiver that no school district has ever held an election on this question so no california school district has chosen to take this question to an election because the education code allows us to seek a waiver of that election requirement from the california state board of education this is this is so routine
that the state board of education puts it on its consent calendar at this point for those of you board members you know that the consent calendars for routine items so you can file a request for a waiver with the state board of education to avoid the expense and the uncertain outcome of an election you have to submit an application to the
state board of education for that waiver as part of the application process you need to seek stakeholder feedback so the district needs to consult with its bargaining units and obtain positions on the waiver the application asks whether they're neutral support or in opposition to the waiver in addition the district also needs to consult with appropriate advisory committees
in that case we recommend the district consult with the lcap committee the dlac committee any other bilingual advisory committees that the school sites might have and then any other relevant committees that the board might think would provide good feedback on this process the board will need to hold a public hearing on the waiver request so prior to approval of the waiver
application the board would need to get input from the community at a board meeting and following that public hearing the board can adopt the waiver request and the application can be submitted to the state board of education it's important to be aware of the state board of education's meeting schedule they meet once every three months so they only need four times a year and
the lead time to get onto their agenda is about at least two months ahead of the meeting so just be mindful of that i always like to put this slide in here um for the members of the public that are watching the waiver of the election requirement uh regarding the question of transition does not eliminate the public's right to
vote for school board members so that's important to keep in mind it typically takes about six months for the school district and the county committee to complete their process and then the state board of education depending on their calendar and when we line up with them maybe six to seven months to ultimately complete the process but assuming we get this process done in
this way this year the november 2022 election will be the district's first bi trustee area election it's important for the sitting board members to understand that even if the transition is completed which we are recommending that it is because of the demand letter that when the rec the transition is completed uh your terms will not be impacted so
for those of you who are on the board until 2022 you will remain in your seats until 2022 and then depending on uh how the trustee area maps play out you may be running for election you may not be but that's a conversation once maps pop up it's hard to conceptualize that without maps for those of you who are on the board
until 2024 you will remain on the board until 2024. um and so the the transition the full transition to trustee area elections will not be completed until after the 2024 election every 10 years you are required to update your maps we are in a really interesting period of time right now um you will be transitioning right now
based on the 2020 i'm sorry based on the 2010 and subsequent american community survey uh census data so that you're going to be transitioning based on relatively old data as it as it is right now and that's because we do not have the 2020 census data yet and we don't anticipate getting that data until september of this year at the earliest so what's
going to happen is that the school district is going to go through this process which is relatively time and labor intensive and then once the 2020 census data comes out the district will need to reconfigure your maps um i know the demographers will do their best to take any sort of new development into account and things like that so that
the changes will be minimal but you will need to adjust your maps again shortly after we uh adjust shortly after we create them uh this year and that's just really kind of an unfortunate circumstance brought about by the delay in the census data for this year so with that after you i just want to make one more
thought once you go through this process in the in the reconfiguration you won't need to do anything with the maps again until 20 after the 2030 census so this will be kind of a whirlwind of of change here this year and early next year but after that it'll all be uh relatively stable so i'm happy to take any questions if anybody has any

evening oh there you go oh there he is just now just in the nick of time you're up justin all right okay so to the president of the board mr schaefer members of the board superintendent dr enfield cabinet and to all our guests good evening many students have excel many students are excited about returning to school moreover
school sites are excited about seeing students return to blended in person learning there is a tremendous amount of energy around returns to school some schools are planning on putting up posters for returning students several schools are planning events for students who are bloody learning and those who are remaining in distance learning ayala high school is planning a
welcome back rally over two days ayala high school is also planning an 8th grade virtual night chino hills high school is working on a back to school video canyon hills is still having bi-weekly lunchtime events briggs is using motivational quotes to help students remain connected bridge is planning a spirit week and don lego is currently welcoming back
students on campus currently there is excitement for schools reopening for blended learning and keeping students connected and get engaged thank you thank you justin and thanks for being here tonight we'll move on now to our employee representatives let's start with miss emily lau vice president of champ good evening president schaefer school board members cabinet and chino valley
community excitement certainly is in the air now that our secondary schools will be opening for in-person learning school site administrators in conjunction with all district departments have been planning this day for almost a full year and are very prepared to safely welcome students back on campus the best way to ensure a smooth transition for everyone involved is for everyone to be extremely clear
about the new routines and procedures that are in place to keep every person on campus safe so i'd like to review some great places for parents and students to find this important information first of all this is especially for parents and students please be certain to read all emails and letters that are coming from your child's school
make sure to listen to the phone messages that are being sent if you haven't had many messages lately check your parent portal accounts to make sure that the email and phone number that is listed is up to date and current also in parent portal check that you are allowing for emails texts and phone messages to go through
one thing that i discovered at my site i'm an elementary site and we've we've been back for a little bit now is that at the end of phone messages that come out there is a a little announcement that asks everybody or anybody who happens to be listening to the message um it says if if um it gives them the
option to press a button to opt out of future messages so if that button was ever pressed in the past you may no longer be receiving important messages and may not even realize it so check the parent portal accounts to make sure that you are allowing for the various types of messages that you would like to receive
another great place to find information is on your child's school website i had fun today i was looking through the junior high and the high school websites and i know for a fact that they are full of information about the routines and the procedures that are in place for students safe return to campus lastly never hesitate to email or call
your child's school on behalf of all the administrators we thank you for your ongoing partnership and support thank you ma'am thank you for joining us this evening next will be mr danny hernandez csea president good evening president schaefer board members dr infield cabinet and community um i want to start off by apologizing for not being able to
log on to our uh last board meeting it was technical difficulties on my end um but it i wanted to thank all the individuals in uh technology that tried to help me that day unfortunately it was my heir um at the last board meeting i did want to highlight a lot of the classified staff that had attempted to get our schools
ready to reopen and accept students prior to the students returning we had a myself and brenda walker had a short meeting with dr infield about what was needed at the school sites the assistance from our m o staff to help put up the barriers around the desk to get schools ready it was all hands on debt from our
transportation department reworking their routes to food services to our district staff and cabinet getting the reopening guidelines finalized it truly does take all of us to reopen these schools it was no short undertaking we still have a lot of work to do i also did want to thank our communications department for posting those pictures on our district website and on social media
not all of us get to see the students return in person but the smiling faces of the students and parents does make it all worthwhile the next reopening of secondary we all uh eagerly await um and with that that concludes my comments thank you thank you sir and thank you for joining us this evening um real quick just uh like every meeting
do you want to remind everyone there is plexiglass between all of us and we are wearing our mask as much as possible moving on now to item 1f comments from the audi uh audience on items not on the agenda we are now at comments on items not on the agenda as noted in the public advisory posted in the agenda
staff will now read under the record names and comments of emails received during the specified window and in accordance with board bylaw 93 23 beating conduct the comments will be read in the order the email was received email comments on agenda items will be accepted during consideration of that item if an unusual amount of email comments were submitted for any item the board
will hear up to 30 minutes of comments in the case of non-agenda items the board can if it chooses hear the remainder of comments after all business has been conducted pat did we receive any email public email comments via non-agenda items yes we received 12 and they are as follows from kevin bushner huge thank you to superintendent enfield
and all five board members for opening all grades tk through 12. i know that the real heroes are numerous district employees all principals and staff and janitorial staff act csca and especially the amazing teachers for the san diego judge his ruling allows all schools in california to open full time in california per the temporary restraining order schools no longer require six-speed
distance and districts are required to provide an in-person education to the greatest extent possible as soon as practical so please do your best to look into this huge thanks to mrs gagne for already replying that she is closely following the case and is the best person to interpret on board we the chino valley parents are going to
continue to push for full-time school we all know especially enfield that the true barrier is the cdph requirement in january for four to six feet of distance in the classroom so we started a petition that has over three thousand signatures so far support opening full-time school and changing criteria to three feet or less cdc should be changing this
recommendation soon to three feet i formally request that parents and teachers get input on how to spend 70 million in coveted relief that cvusd is receiving and a true audit of the funds every board member should be requiring that right now please seriously assist the high school principals in looking into amazing options for in-person prom and graduation we already know kids don't
spend covet easily spread copic easily so there are options to consider thanks kevin march 17 2021 the judge approved a revised temporary restraint restraining order against the state the state is prohibited from one applying and enforcing the january 2021 framework statewide for beat space and stable groups etc two applying and enforcing anything similar that includes provisions of the
january 2021 framework statewide three applying and enforcing the state review request decision statewide i.e denial of our waivers for march 7 2021. furthermore school district's name and the complaint are ordered to appear on april 1st to show why they cannot reopen their schools for imprisoned instruction to the greatest extent possible at the earliest practical time rudy and jay beige to china valley
unified school district board members i am a parent of a third grader who is in track b distance learning model i am writing to express my deep concern and disappointment for the way distance learning was organized when the school reopened for blended learning while there was a great effort to get students ready to learn back into the
classroom there was a complete oversight in how the distance learning students would continue first there was a lack of communication to parents specifically with district learning schedules start times were not communicated before the start of the blended learning day no email no phone blasts parents had to call the office that very morning and even the office staff didn't know
the start time we need better communication about all learning models not just blended learning this particular class did not have a teacher for two days two days of education lost no lesson plan no instruction on state standards third there was no handoff between the outgoing teacher and the new teacher miss masonic about the lesson plan it took
one week before the new teacher was on the same page where the previous teachers left off i simply cannot accept that the handoff between the teachers had to be delayed for one entire week what was the school's responsibility to these children during this time you ask us for our patience and understanding at this time of change yes we have been patient with these
changes and we understand that is not not been easy trying to reopen our school we are asking for your help now in addressing the needs of our specific class the learning plan needs to be addressed sooner we need better communication with schedules and class times and we need our kids to learn let's figure out who can take action on this
immediately because our kids deserve it thank you for your time rudy beige cal errol parent kerry shot good evening dr enfield and school board i am grateful that our children are finally going back after so after so much has been taken from them by our governor that has violated the constitutional rights of millions of children in this
in this state for more than a year now what a tragic tragedy it has been for way too long now and it is clear that we can never allow someone to do this again to our children i am requesting dr enfield that a date is please discuss here tonight for opening all of our schools to full-time in-person instructions
we legally have the ability to do so to due to the temporary restraining order against the state that was granted yesterday in san diego county our understanding is that this border allows all school districts to open full-time in california i also was told that we have a very limited window to do this only two weeks so i'm asking you tonight
to please vote to open full-time in-person instruction for every everyone in our schools it is very concerning that our community is already hearing that our district may wait until the temporary order is permanent this of course could take months we cannot for one moment risk waiting if we are given the opportunity now we are losing the entire school year
there is no more time to wait please do the right thing tonight for our children with 70 million in coveted relief for our school district and now the legal avenue should move to full time our children need to fight for them by giving them back their educational rights that have been so unfairly stolen thank you for all that you do and for
your consideration on this urgent request to get back to full time if a vote can go forward on this tonight it would be so greatly appreciated especially by all of our children we cannot miss this opportunity that we have to open fully from kristen kim to chino valley school board first i'd like to start off by thanking
you for taking the steps to getting our kiddos back into the classroom my son is already a happier version of himself with two days a week imagine how much he and others would thrive if they could go back full time this is this leads me to the reason for my email this may or may not be no information for you so i hope this
motivated you to start planning on bringing back the kids full-time a lawsuit was filed against the state of california for its 2021 framework and there is now a temporary restraining order against it this was filed in north county san diego and is applicable across the state i have attached the proceedings and highlighted a few points in the
judge's ruling to sum it up the 4 6 rule is now null and void as well as the idea that 7th and 12th great can be treated any differently than elementary and that all schools need to provide the full provide the fullest extent of in-person education that is possible there will be another hearing in two weeks that will make this injunction
permanent please be prepared we want our kids back full time below are a few points from the judge and an article from the wall street journal attached is the court ruling please please feel free to reach out if you have any questions while the court acknowledges the state defendants have a compelling interest in protecting the public by stemming the spread of cobat 19 the
court cannot conclude that the january 2021 framework is so narrowly tailored to serve articulated compelling interest to the contrary the january 2021 framework is selective in its applicability vague in its terms and arbitrariness prescriptions plaintiffs also contend that the state defendants as well as the defendant's school districts are in violation of california education code section 435048 a particular section
43504 b requires the court is perplexed by the state defendant's contention that plaintiffs and their ex parte papers failed to address among other things the claim under sb 98 to this point in their ex parte application plaintiffs expressed the state which statements supported by the evidence submitted that numerous schools in the state indeed several located within school
districts named as dependents have reopened demonstrating not only that it is possible to reopen but that it is possible to do so safely without the new and arbitrary rules of the january 2021 framework while the court concludes that california that a local educational agency shall offer in-person instruction to the greatest extent possible sincerely mom michelle savage can someone please
acclaim explain to me why we are taking this away from our kids how is it that football can practice and play boys in close proximity and hitting touching each other but the girls boys of sideline cheer cannot stand on the sideline and sure while not even touching each other this is unbelievable to give something to these kids and then
it right and then it away without a single thought to their mental health and how this will affect them these kids were actually excited to have something for their year especially the seniors who have had nothing these rules regulations literally make no sense in regards to overall health and well-being if they did then football and in-person school would be cancelled
sideline is no different i understand if l.a county won't let them cheer but that should not impact what we allow in our school at our home school in our district do the right thing michelle savage chino hills high school joseph chavez why is it acceptable to have kids return to school for on-person learning but not to allow spirit leaders to cheer on the
sidelines of a football game when they are six feet apart wearing masks outside these kids have been robbed of a year of school activities socialization and a spirit decor please rethink this draconian guideline joseph travis stephanie parker hi our girls have been through so much this season they didn't get to practice much together they didn't get to compete
then they lost their coaches and after everything we finally saw a light at the end of the tunnel when they were told yesterday that they can cheer at the remaining five varsity football games and possibly basketball when it starts now today the rug was ripped from under them yet again i'm devastated for my daughter and the rest of the girls who
are going through this it's unfair why is cheer song being singled out they're also a sport they were supposed to be allowed once we've reached the red tier i'm begging you to reconsider and allow these girls to participate and do what they love thank you for taking the time to read this luis chavez hello board members i find
myself disappointed to be back here again sending another email to you regarding our district spirit leaders i have had a hard time understanding how a group of kids standing six feet apart wearing face masks are being denied the opportunity to participate in sideline cheering it makes no sense to me that my child can eat in a restaurant go to a
movie attend school on campus but she cannot participate in sign language cheering i am confused and do not understand how you determine which sport groups and activities are essential or better yet safe to participate in i'm obviously sending this email requesting the board to reconsider allowing sideline sharing at all sporting and school events thank you luis jones
adrian tabaji our school doors opened understaffed and unprepared there were not enough teachers to accommodate our distance learners some students did not have a teacher the entire first week removed from their online classes with no direction the district knew exactly how many students were hybrid and how many were staying online why would you open a school without proper staffing
no staffing or boarding or onboarding was done until march 8th with school open even today there are still teachers being placed and put in impossible situations just because there is a teacher present does not mean the quality of the education has been the same we are currently on our third teacher there's nothing short of having a warm
body there while our hybrid counterparts have been able to keep their teachers with minimal disruption the other students have suffered a great loss for choosing the alternative you have set your teachers up to fail with no training on current online platforms and not even a warm handoff from the previous teacher what we have been provided has been less
than adequate sloppy rush and should have never been open until we were ready trained and fully staffed kristen lourdes hello thank you for reading my email my daughter sydney attends geno hills high school and is on the varsity song team her team got to practice yesterday on campus and was getting ready to cheer at tomorrow's football game
today we were told that they were unable to cheer on the sidelines due to guidelines outlined by the state i'm having a hard time understanding these regulations how can it be safe for football players to play their sport but not cheerleaders and song team it seems very discriminatory that boys can play football but girls can't cheer please direct our administration as to
how we can make this possible for our girls they have already lost so much this year and time is running out for them there are only five games they could cheer at please make a decision today this is a time-sensitive issue thank you for your consideration christina lourdes joanne garcia hi my daughter is a spirit leader at chino hills high school they
were told earlier this week that they would be able to cheer at the five football games that are being played this season she was very excited to be able to participate then they were informed this afternoon that they would not be able to cheer at the games for health guidelines i am i am inquiring to this board to please
make an exception and allow them to cheer at the games they are following phobic guidelines and will be standing six feet apart and wearing masks and wearing a mask the sport teams are able to have a season and play their sports while either wearing or not wearing a mask and being in close contact with other players while our girls are being denied an
opportunity to share games while following safety guidelines doesn't seem fair again please review your guidelines and for the mental health of our students please allow the girls to cheer on their classmates at these football games thank you joanna garcia finally lily lopez i am concerned and frustrated i am a concerned and frustrated parent of a chino hills high school cheerleader
i would like an explanation as to how it is allowed to get the spirit leaders riled up and excited to finally participate in something somewhat normal and then have it taken away from them what another disappointment for those of us that have seniors and have had disappointment and disappointment this past year i understand it's because of covet but i
also understand that the district is allowing other extracurricular activities such as track baseball softball and what about football they would play without masks and have contact with each other our girls are six feet apart for a mask and have no contact with each other this is beyond unacceptable how much more can be taken from these kids and at some point you all
should consider what this is doing to them mentally you gave them some semblance of normality and yanked it in a heartbeat you should all be ashamed of yourselves regards lily lopez and that concludes the public email comments thank you pat and thanks to some of those who submitted letters tonight now moving on to uh item 1g changes and
deletions pat do we have any changes in deletions tonight there are none thank you moving on now to uh two action items the first item is item 2a1 the 2020 2021 second second interim financial report recommend the board of education approve the 2020 2021 second interim financial report and authorize the president of the board of education and the superintendent to sign the
positive certification of financial condition for the current and two subsequent fiscal years are there any emails ms pat there are none may i have a motion so moved second promotion by mr gnaw and the senko by mrs gagne any comments questions or discussions from the board mr bridge yes uh i would like to um excuse me dr enfield on uh on the page uh
right in the front of the book restricted fund only if i could if you give an explanation of under books and supplies it shows under the second interim a significant high higher number than than the other years uh from the united actuals and and to the estimated budgets in the future and i just wonder if there you

framework the january 2021 framework violates the equal protection costs set forth in the california constitution the state defendants are in violation of sb-98 and states that a person may not be deprived of life liberty and property without due process of law or denied equal protection of the laws education is a major determinant of an individual chance for economic and
social success in our competitive society and also they also have this part the state defendant's council conceded at the onset of the march 15 2021 hearing that the stable group's reference is a guideline not a requirement moreover the state defendant proffer no satisfactory justification for the arbitrary retreat from the previous prescribed social distance requirement which provided rigorous to the four feet
mandated by the january twenty twenty first so they do they are they are asking a deadline for the state to reply back on march 26th but the whole framework has been you know seems has been evoked and so in doing so you know you know it's based on you know safety and precaution of based on what the school district would
prefer but you know we should start we should start going full time and um like i said especially for for song and cheer and cheerleaders they should start playing today with the football guys and um you know this this this um judge order you know it emphasized the emotional state of of students and how they've been impacted

on lincoln and his name is dr gert vanden bush cdc good news is that only one child died from the flu this season also cdc cdc has admitted face max do little to prevent the spread of coping 19 and been mounting pressure to lift mass mandates across the u.s a new study the cdc found mass had a negligible impact on coronal bias
numbers that didn't exceed statistically margin ever error so the risk outweighed the benefits you know there's something that we should definitely contemplate when the cdc gathered all this information into their testing um answers before considering getting a vaccine especially for your kids as the months roll by so these these are 12 facts that i want you to reflect before you give it to your
students your children if i get the vaccinated can if i if i get vaccinated can i stop wearing a mask no if i get vaccinated with the if i get vaccinated will the restaurant borrow school fitness club hair salon reopen and will be able to get back to work like normal no if i get vaccinated will i be resistant to covet maybe
we don't know exactly probably not if i get vaccine at least i won't be contagious to others no the vaccine doesn't stop transmission if i get vaccinated how long will the vaccine last no one knows all covered vaccines are still in the experimental stage if i get vaccine can i stop social distancing no if my parents grandparents and myself
all get vaccinated can we hug each other no so what's the benefit of getting vaccinated hoping that the virus won't kill you are you sure the vaccine won't injure me no if statistically the virus won't kill me 99.7 survivor weight why should i get the vaccine to protect others so if i get vaccinating can i protect 100 of the people i come to contact with
no if i experience a severe adverse long-term effect or die from the vaccine will i be compensated from the vaccine manufacturer or the government no the government and the vaccine manufacturers have 100 zero liability regarding this experimental drug so when you look at the risks and benefit ratio when that time comes you may want to vaccinate your whatever
you call this thing you should consider and reflect and do your own research i still believe in you know i know parents decided to you know they decide what learning modality they wanted in august i think they did it in january too but ultimately i don't believe parents should be forced and you know there's a lot of things
going on right now a lot of dynamics you got you got elementary kids going now you got the high school students so you've got a situation where parents because of work because of of things that have been very um inconsistency that they may have a hard time thinking how they should work this thing out so i really think that we should
if if parents want to change they should have the right to change now for teachers knowing that schools have been opened you know we should focus on teachers and obviously they know what worked and what didn't work so we should definitely get feedback and um and listen to our teachers and as for parents we should support them
and and help them any way that we can thank you mr nah um i have attended a celebration of life of a mother of two children and both of those two children are attending our schools it was a very sad situation especially for the children the father was there and he was extremely in a shock and the kids were continuously crying
and we need to really pray for them these are the kids that who are coming back next week in our high schools so as an adult from site admin to other teachers please be kind and support our kids especially who have gone through uh such a painful experience in their lives and not just these two childrens i'm sure we have many kids like that so
thank you uh for your kindness that you're going to portray on them i had a chance to talk to uh yes the cheerleaders in the front in the parking lot and also a parent and i would have to agree with him 100 percent they said how could a football players play in a context sports and and you're not
allowing the cheerleaders and song leaders and spirit leaders to be on site when they have their masks on and then safety distance rule has been followed that doesn't make sense is any possibility to allow our cheerleaders and spirit leaders perform on tonight's ile game uh dr enfield it's already seven o'clock so i'm sure it's going to be very difficult but i'd
like to ask you to consult with our legal counsel see if we're able to allow our cheerleaders to perform at school events especially uh there's a citation that that came up on surface where judge had ruled and given restraint order for a california framework so i think that's in many parent's mind too so i think we need to be proactive and and supporting
opening up our schools for our students sake because we're taking all the procedures that is necessary to safeguard them from covid i support opening up full campus and also allowing our cheerleaders to be on on their field it's not our field it's their field to support their peers thank you mr bridge thank you i had the opportunity last week to
observe the return of some of our elementary students at three of our campuses and i would like to take this time to thank the principals at those schools paula thomas at rolling ridge patty jewell at cortez and dr patricia custodio at levi dickey for showing me how the classrooms are set up with the various protective equipment and how the classes are being separated
outside for recess and lunch i could see that the students were wearing face coverings and all indicated when asked by the principals uh that they were very happy to be back and i would also like to thank the teachers and staff at those sites and all of our schools for the hard work they're doing setting up their classrooms as our
students return now with san bernardino county and the red tier i look forward to having our secondary hybrid blended classes learning classes returning next week i know the high school or the athletes at the high schools are excited to be competing in their sports as well in fact driving over here this afternoon and coming by don lugo
it was very nice to see the softball game going on and also football on the on the field as well so yesterday um i had the pleasure of participating by zoom with other board members from upland and fontana unified for the student advisory panelist presentation sponsored by the san bernardino county schools and superintendent ted alejandre high school students in
teams of four then made 20-minute presentations on one of four priority areas in those areas where education access to health and wellness economic econ the economy and safety they address these factors through the disruptive impact of covet 19. i can say that the presentations were excellent even i i learned a lot from their presentations and i also understand
we'll have students from don lugo and ayala high participating in these sessions tomorrow and board members when we signed up were assigned for one session and mine was uh yesterday and i believe mr shaffer is scheduled for tomorrow and you will hear some very interesting presentations i can assure you uh also i wanted to uh uh recognize with with a bit of with some
sadness that the chino valley lost a community giant last week mr al mccombs long time owner and publisher of the chino now chino valley champion uh the champion will have a write-up in the paper on on saturday morning that that hits our driveways but what i would like to note and you may not be aware of is that mr mccombs
served as a member of the school board from 1969 to 1979 serving as president of this board for two years and his clerk for three years and i know many of us are going to miss uh reading his uh column every week in the champion it was one of the first things that many of us picked up
out of our driveway with the other other papers and and usually read cover to cover first thing it was just sad to see but a definite giant he will be missed and i certainly want to offer my condolences to the family and finally this is our last meeting before spring break so i wanted to wish everyone an
enjoyable spring break week beginning on the 29th and that concludes my comments thank you mrs garnier yes good evening uh tomorrow i will be attending an education roundtable that is being held by assemblymember freddie rodriguez who covers chino as well as the part of south ontario that we represent the round table is clearly focused on education initiatives generally but
i am going to to take the message since i think it's unavoidable that you know we need some more leadership from the state legislature i think that there's been issues referenced tonight about new guidelines i don't negate that these guidelines are now inconsistent don't make any sense in some respects might be viewed as retaliatory due to other court decisions that have
happened over the last couple of weeks but i do think that the state legislature needs to step in i think that it's the time for us to lean on our elected officials that represent all pockets of the state and get some clarity because the reality is and i appreciate all the emails that we get on these issues the board is
not making these decisions we are having to administer in the districts having to administer these guidelines and administer these decisions and at some point uh you know clearly now we're in a an environment where some of these are are clearly just not consistent and that's where i have a problem with the youth sports q a that was released
earlier this week it does not make any sense given what we're allowing some of our athletes to do and we're not allowing our cheer athletes to do to do other things which clearly are more socially distant and arguably more safe so um you know i i hear the community's concerns um and i know that many people in this
community are are tired of the application of executive power in the state uh you know related to this issue but i i would like us to to press our state assembly members and if you email with me i probably have encouraged you in some respect to contact our state assembly and state senators because you know we we do need
our you know local elected representatives who are from this district to hear us and know you know what's happening here and what the impacts are so with that i'll end my comments thank you dr infield has no comment this evening so i have just a few first i'd like to say that i was able to join mr bridge and the campus tours i joined
him in an attempt to create the least disruption on our campuses as possible so i thought if we visited the same ones we were only disrupting those campuses i would like to thank the principals and staff at those campuses along with the students for welcoming us and allowing us to walk the campuses those days the other thing
i will touch on i think all of us have touched on a little bit a couple of my fellow board members commented it's time to get the kids back and doing everything i don't think there's one of us up here that doesn't want that that doesn't that doesn't want to see our kids cheering playing sports in the classroom
five days a week but the reality is at this point in time that all these decisions are not left up to this board unfortunately we still have to abide by the california department of public health other state agencies in our county health department do they make sense no am i frustrated yes i'm very frustrated at the inconsistencies in the
way in the way these things are rolling out that some of our kids are being able to participate in extracurricular activities and some aren't i don't think it's fair i know that dr infield and staff are working on this tirelessly i along with some other board members are working daily with outreach to our elected officials at the state and the county level to try
to get some equity in what this reopening plan is should look like not what it does look like but what it should look like and again i appreciate all the emails and i feel your frustration and i understand your disappointment but please know that some of these things like i said are out of our hands at this point
i'm pushing heavily every single day to allow local control so that the five of us up here can make the decisions that we know are best for our students our families and our community i haven't been successful with that yet it doesn't mean we're going to stop trying so again please know that every single one of us
