it is four o'clock i call to order the special meeting of the board of education tuesday december 7th 2021 at 4 pm with bridge cruz gnaw and schaefer present and mrs gagne is participating remotely at the location noticed on the agenda and she has confirmed that the agenda has been posted at location accessible to the public please stand i'll be leading us in the
pledge tonight your right hand over your heart and to the republic for which it stands one nation under god indivisible with liberty and justice for all subscribers okay moving on to item 1b comments from the audience on the only agenda item we are now comments on item on the agenda pat are there any requests to speak mrs gagne do you have any requests to
speak at your location i do not thank you speakers will be called in the order the request was received please listen for your name and be prepared to approach the podium mr bridge will you please explain the light system speakers you have three minutes to address the board please limit your remarks to new points again comments the green light yellow
light means you have 30 seconds left the red light means your time is over please adjust the microphone as necessary before you start your comments and audience members please refrain from making comments while the speakers are at the podium so they have their maximum use of time thank you pat before you call the first speaker um just a little background this
is a special meeting the only agenda item is to discuss the potential effects of a vaccine mandate for district employees this is in lieu of what was going to be a round table discussion so it won't be as much of a back and forth as as i had originally hoped but we will still be able to receive your comments
since it is a special meeting and we only have one agenda item comments will only be accepted for this one item nothing else this there are no public comments on non-agenda items tonight simply uh comments on the agenda item first speaker please carla vandistique followed by miss vandell julie vandell followed by chris stevens good afternoon board and dr infield and
our other bosses thank you for taking special time out of your day to be here to hear our concerns about the coming mandate and for protection of our jobs we all hope for more of a conversation as did you but maybe that will still come at a later date we do know that there is no vaccine mandate at present however on
october 1 2021 governor newsome issued a statement that there will be a covet-19 vaccination mandate for all students k-12 in public charter and private schools and all school employees as early as january 2022 that statement is why you have an organized group of people sharing their views with you this afternoon we are presenting data to you tonight to encourage you to not
enforce or comply with the mandate when it comes please take this info to heart and deeply consider it we are real human beings with real responsibilities and we really love our jobs we are not just an employee number you know some of us maybe many of us the governor does not know any of us take it take this personally because
it's deeply personal to us we are your people and we love and want our jobs there are many other districts in california who are taking a stand against this unconstitutional illegal mandate you will not be alone if you stand against this lit mandate you will not be alone if you stand against this mandate you can stand with other courageous
boards who value their own people and value medical freedom 58 districts have written letters to the governor 31 have adopted resolutions and seven have voted to not comply or enforce a mandate on students or staff many others are in the process of developing a plan right now no other state has followed suit with newsome to implement a vaccine mandate for students
in california the only two districts that have at this point implemented this are lausd and san diego they already have had a lot of pushback and are facing numerous lawsuits from parents and staff please join the other california districts and stand for the right thing and for giving your employees the freedom to choose what to do to their own bodies which gives you
medical freedom also and you'll want that when more mandates come and it will also protect this district from mass exodus and lawsuits where there is risk there must be choice [Music] julie vandell followed by chris stevens good afternoon today i will be listing for you some of the companies hospital systems and government agencies that will not be
enforcing the covet 19 vaccine our hope is that you join the fight for medical freedom with these companies you will not be alone first here are 13 healthcare organizations that are suspending the covet 19 mandates the citizens medical center in victoria texas the daytar healthcare system in victoria texas the advent health in altamonte springs florida the tenet healthcare in dallas
texas cleveland-based university hospitals the cleveland clinic the bay health in dover delaware the bieb healthcare in lewes delaware prisma health in greenville north south carolina intermountain healthcare in salt lake city hca healthcare in nashville tennessee st joseph regional medical center in lewiston idaho ballot health in johnson city tennessee next here are some companies that you will recognize in and out chick-fil-a
home depot publix kroger southwest airlines american airlines delta airlines and the united auto workers union just to name a few lastly the la county sheriff alex villanueva said he will not comply with the vaccine mandate he fears that if he loses deputies that it will lead to more crime the riverside county sheriff chad bianco feels it is government overreach
and it should be a personal choice he will not enforce the mandate prison guards are also not mandated in fear that the prisons will be under staffed the u.s postal service is concerned that the mandates could lead to high levels of absenteeism and effect deliveries chino valley will face the same problem our students will suffer if their
teachers and support staff are forced out we will not walk away you will force us what are you going to do when you lose 500 plus chino valley employees what are you going to do thank you chris stevens [Applause] my name is chris stevens i'm a 27-year teacher and football coach and most of those years have been serving the chino
valley unified school district my wife and i have three kids in this district and i'm coming to you today to express my deep concern over this vaccine mandate i believe it's unconstitutional and we have we as parents should have the final say with what we give to our kids the mandate coming down from governor violates the constitution of the united
states the freedoms that we have include health care and i want to be very clear i'm not against the vaccine itself i'm against the mandate i have friends and loved ones who have taken the vaccine and i support their decision to choose the point is that now we still have that freedom to choose the mandate has not
taken place yet and we still have time to do the right thing what i'm proposing is that we form an alliance in freedom not medicine those that have raised children i'm sure that at some point you can remember you had lots of concerns when they were young about their well-being and their health and you did everything in your
power to be the best parents you could possibly be to make sure that they were safe and they were healthy would any of you have given that power over to someone who doesn't know you or your kids and would you trust that person with your lives and the lives of your children we need to understand that someone who doesn't know us or care a
lick about our kids is telling us how to provide care for our kids and that just doesn't make sense to me especially when there are risks involved we don't want to have to pull our kids out of this district that we love so much my wife grew up here going k-12 and she currently is a substitute in the
district i did my student teaching at canyon hills junior high my first job was at boys republic teaching driver's ed we grew up in the chino valley and we're very passionate about this place that we call home so why are parents so skeptical about mandating the covet vaccine for children when many other vaccines have already been required for school that's an
important question it's a question that needs to be answered we already get vaccines in medicine so what's the big deal right here are some stats for some other vaccines the polio vaccine child mortality rate at the time 10 percent years the vaccine has been in use 69 years the pneumococcal vaccine the child mortality rate was 18 percent years the
vaccine has been in use 41. smallpox child mortality rate 30 years vaccine has been in use over 200. covet 19 child mortality rate is one ten thousandth of a percent the years that the vaccine has been in use less than one year we know that there are side effects to this vaccine it's been proven that there are children with myocarditis and young
ladies who have had their reproductive system affected i will not take the chance that it could happen to my children because my district decided to fall in line with this governor's mandate we will not do that doing what's in the best interest of our students that's the rally cry of our district and the district motto right above us
says student achievement safe schools positive school climate if you comply with this mandate it will not be in the best interest of all of our children and this will not be a safe place for our kids thank you kyleen vias followed by deborah rosen followed by crystal flume good evening distinguished sport thank you for listening to our voices tonight
my name is kylie baez and i'm a 20-plus year classified district employee i'm homegrown born and raised in this district i graduated 97 from ayala high school my mom was also a former employee 23 years before she passed away this district and this career is all i have known for over 20 years i would like to present to you tonight
some data that has been brought to light with regards to the topic according to the usda powerpoint from october 22nd of their meeting with the usda and pfizer i bring your attention to a few of the known side effects of the vaccine that were known to the fda before the vaccines were brought to public light no a total of 32 and i've highlighted
them let me give you a few these were known that they did not release to the public when you were signed away for your knowing myocarditis death gillard bear syndrome multi-inflammatory syndrome in children and early birth and pregnancy to name a few of the 32 allow me to read to you some of the 102 pages from the k series drug analysis vaccine
pronoun from the coven 19 mrna pfizer biomentech vaccine from the uk these are actual people not just numbers that now have these side effects blood disorders 13 226 gastrointestinal 35 550 muscle and tissue disorders 45 701 nervous system disorder six hundred and seventy one reproductive disorders men and women twenty four thousand five hundred and ninety five and it wanted early pregnant
pregnancy death 565 that's in the uk that's smaller than the u.s from theirs in america as of november 27th miscarriages of wanted pregnancies 3148 heart attacks 9746 myocarditis 15 424 permanently disabled 31 652 heart attacks 9746 severe allergic reaction 34 481 life-threatening reaction 21 932 death 19532 total reports 927 7738 of adverse reactions to the cova 19 vaccine this is
just one percent of the various report one percent with all of these effects and adverse reactions in a declining enrollment district where is cvusd going to get the funding for the lawsuits that the staff and parents will bring to your doorstep when natural immunity is being reported george mason university had a case where the cdc could not report had no record
of natural immunity a person with natural immunity transmitting the virus vaccinating millions of people from the who emergency director mike ryan stated december 3rd there's no evidence that boosting an entire population offers greater protection to healthy individuals these are stated studies these are not just opinions thank you for your time i hope you consider this deborah rosen
followed by crystal flume followed by christina as the board of education you have a very important choice in front of you you can stand with newsome's mandate or you can stand with the courts in this country and their current legal decisions we urge you to follow the legal precedents that have been set in our judicial system some may argue that we must follow the
governor's vaccine mandate because it's the law but the united states courts had something to say about that this last month district courts federal courts and now appellate courts have all suspended the federal government vaccine mandate on employees state attorneys private and public sectors have all successfully sued and won against the federal government imposing vaccine status as mandatory for continued employment
so if we as the cvusd plan to follow the law then we cannot turn a blind eye to the current court decisions allow me to direct your attention to the three court cases halting the vaccine mandate nationwide in this country all of which i'll be giving to you the latest blow to this mandate came from the federal judge in louisiana
whose order came on tuesday november 30th blocking the health care worker vaccine mandate nationwide hundreds of thousands employee jobs saved if they chose not to get vaccinated secondly let me direct your attention to the u.s court of appeals with the fifth circuit on november 15th halted the enforcement of the osha regulation mandate for employers of a hundred or more
people and they found quote likely unlawful unconstitutional vast government overreach into the private sector third allow me to direct your attention to a federal u.s judge gregory van gatenhoven of kentucky who on november 30th granted a preliminary injunction against the kova 19 mandate on all federal contractors and subcontractors this too has saved thousands of jobs rather it's a district court a federal
court or a court of appeals the vaccine mandate has been halted as quote claiming authority over employee private lives and vaccine status as an agrarious government overreach as stated by the fifth circuit court of appeals as they reaffirm the suspension of this law if the board chooses to follow the governor's mandate over the courts in this country
then the teachers and the staff and the community and the parents will use all of those court cases to hold this board legally and financially responsible we must follow the law we wholeheartedly agree but the law is interpreted in the courts and not created in a governor's office we urge you closely to follow the legal rulings we as staff teachers and parents
will be we stand together with the courts in this country and we will continue to beg you to do the same thank you for your time [Applause] followed by chris followed by christina followed by arlene lamb hi my name is crystal phleb i have been teaching kindergarten and chino for 21 years like many of the teachers who
spoke i was a student in this district from kindergarten into the 12th grade i currently teach kindergarten in the classroom i went to kindergarten inn back in 1983. it is not feasible to terminate the number of employees due to the vaccine mandate we all know there's not enough teachers and staff members as it is at my school site there's at least two days
a week sometimes three when there's no custodian due to staffing shortages we're supposedly in a pandemic but our school isn't even being cleaned properly being a teacher is our calling and our livelihood but it's also the way we support our family and we put food on our table please do everything in your power to make sure we keep our jobs we cannot
afford it and neither can the school district with only 18 days until christmas we are in the christmas season for sure give us all a christmas miracle today tell us you us you will promise us now you will do everything in your power that you will not terminate us as employees and teachers um you have do everything in your power that you will
not cause us to lose our jobs and so many students to leave this district merry christmas and god bless you christie christina followed by arlene lamb followed by tanya macias good evening board my name is christina i have 14 years vested in cbusd thank you thank you for giving us an opportunity to speak today hopefully everyone will get their time
and it will not be in vain a quick peek the overflow room is packed am speaking on behalf of classified staff against the mandate this week there are 37 classified job postings with over 42 positions available seven of those positions date back prior to the 21 21-22 school year beginning and have not yet been filled additionally five of the 37 postings are
for instructional aides with multiple positions within one posting how are our students being supported with so many vacancies we have vacancies in nutrition custodial technology and admin support staff if this mandate continues for staff without the backing of the district there will be more vacancies at my site alone ayala high school there will be a 45 percent shortage of classified staff
to support our administrators teachers parents and students and eventually a lack of support to our district what is your plan who will provide technology support for our 21st century learners using chromebooks every day who will be serving lunches to our population of 2 700 students how will our schools be cleaned and disinfected to provide a healthy learning environment
who will the students come to for their health needs who will support our teachers who will how will we remain compliant with iep goals these are the questions we were hoping to have in a dialogue about when this meeting was first initially initiated by mr shaffer to our staff group leaders not a three minute go through it as fast as you can and
hope they are listening speech as i pondered why this meeting grew to be a special board meeting i realized it was to the best interest of staff to make this meeting public so our community can see what is at stake to show our community that this is mandate that this mandate passes for staff to be coerced into getting the
shot or vaccine or booster or whatever you want to call it that have proven not to be fully protected for us there will be exponential consequences as a registrar i have spoken to many parents who are on the verge of pulling their students out of schools it takes a toll on me to be to ask them to be patient and to
encourage them to stay i ask each of you to use common sense as mr nah has so graciously explained think through your decisions how it will impact many many families if we have so many vacancies now will you be willing to fill the gap as for me i will not comply to an unconstitutional tyrannical mandate set forth by the governor
i will take the necessary steps to protect the vaccine to protect the vaccinated but i ask what steps are being taken to protect the unvaxed please make the right decision stand for medical freedom and keep our students in school stand for the staff and keep the district unified we do not need another reason for discrimination based on
medical status i urge you to join other districts and support their staff for medical freedom arlene lamb followed by tanya macias followed by elaine maxwell good afternoon my name is arlene lam i've been an employee of this district for 30 years and i am not vaccinated for the past several months we have seen vaccinated people contract covid so we
now know that the vaccine does not keep people from getting the virus as we were once led to believe in the past nearly two years there has been a lot of discussion of following the science well i have had covid and the science tells us that i am far less likely to get covert again and spread it to others than
someone who is vaccinated but has not had covet i also have many concerns regarding this vaccine as we have already heard this afternoon there have been many cases of people who've had serious health issues after getting the vaccine remember it is still experimental and just as many people in this district have chosen to get the vaccine which is
100 percent their right i choose not to president schaefer and members of the board you have the right to stand up for all of the cvusd employees and fight for us thank you for your time tanya macias followed by elaine maxwell followed by kimberly barreras good evening board members and dr enfield this is what i was going to give
at the last board meeting before we were cut off and not given the time that we deserve the last board meeting i was never i have never in my 19 years here in chino felt so devalued as an employee i honestly was sickened completely sickened when i left here i was i can't believe how we were treated
i i really feel like we are owed an apology i appreciate this meeting i really do but i i felt like we should have got our time last week at the last board meeting um with that being said we were all planning on letting the board know what what amount of years and service we've given to this district and so i'm going
to go ahead and do that now i'm a 19-year veteran here i was hired in 2003 i've taught grades four five and six nine and ten english i'm credentialed in k-12 i've been trained in thinking maps pbis international baccalaureate i've taught combo classes i'm trained in glaad i'm trained in google classroom i'm trained in step up to writing i'm
trained in deconstructing standards i'm trained in unwrapping standards writing learning targets i'm trained in the plc process i'm trained in read 180 i'm trained in avid i'm also love and logic trained currently i'm teaching at don lugo i teach english i also teach credit recovery classes i'm part of a wasc accrediting visiting committee i'm also a master a master teacher
and to a future english teacher i've had the pleasure of influencing over 1500 students lives i planned on retiring in chino i in about 10 years or so and we say that we care about kids here in chino prove it prove that you care about kids and keep all these amazing educators prove it and stand up to the mandate
because you know you can other districts are doing it keep staff like me and everybody else thank you elaine maxwell followed by kimberly barreras followed by molly large thank you good evening doctor and bill board members mr right out you know i have to admit i did not know i was going to speak today when i came
here we received your uh email dr infield stating that we were going to have this open session where we could all speak about what our concerns were i mean look at this and that was taken away from us and it was taken away from us because of the brown act i'll be honest i'm not familiar with that
however we have so many more colleagues and staff outside waiting to tell you how we feel i've been a teacher in this district for 18 years it's a second career for me i chose to come here both of my children graduated from china hills high school i teach collaborative kids at ayala i teach the erwc program at iowa i feel
that i contribute a lot i feel my life my rights are just as important as the next person we are all here for our students we're all here for our kids that's what we do this for as you know teachers do not make a great salary so we sure have don't do it for the money and we are having those rights stripped
from us these are our god-given rights to do what we want to do with our body we want to teach our kids we don't want to see everybody leave we're not going to walk out you're going to have to force us because we love our kids and that's what's important to us is our children kimberly barreras followed by molly
large followed by carrot kathy logan hi so just like mrs maxwell stated we all came here for questions and responses we wanted to have a discussion with you guys so um i'm not going to sit up here and say facts because they like out beat me with all of the facts um amazing facts by the way um so i'm going
to ask if i can give the rest of my time so you guys can have that discussion and tell us some of the solutions that you guys are coming up with to keep all of our jobs and what solutions are you coming up with for our students that are not willing to take this vaccine i can tell you right
now i'm a parent i have two kids that are in chino valley and they are not getting the vaccine whatsoever so what what are you guys coming up with that's what we all came here for we came here to have a discussion we don't want to argue with you we're we've already done all of that um so
i i just want to know if you guys can actually have a discussion with us and give us some answers because we came here to hear what what you guys what you guys have we want to know i think you've heard everybody here so are you guys willing to respond to our our questions and to have some solutions
for us can i give the rest of my time for that pat um yeah so the way this is going to work is we're going to allow all the people to put in spirit cards to do to make their comments the board is going to then have a discussion time and at that point we can open it up some dialogue so
you're going to have an open forum like we can ask you questions after that is that correct i would encourage you to put your questions forward now because the dialogue will be between the board members but we may incorporate those questions into our discussion unfortunately when this went away from a round table to an actual board meeting
we lost some of the fluidity so to speak in the process right and i do apologize for that we all came here so that we can have that open fluid discussion instead of like shouting and things like that you know we wanted to actually hear can i make a motion that we have a dialogue and an engagement there's somebody here
speaking it's a special board i'm i'm okay yeah so we're going to allow the rest of the speakers to continue and if you do have questions i encourage you to put them forward during your comments and then we will try to address them during is there a possibility that we could have an open forum discussion so that we
can ask you questions you can respond instead of just having three minutes can i have a point of order um i'm just going to sort of explain why this went from a forum to a meeting um i i was not part of the genesis of the forum i believe was mr schaefer mr bridge i think that their intent was um and the
reason that i wasn't a part of it is not more than two of us can host a dialogue or a forum at a time without violating the brown act um so i wanted to respect their right to have that forum and my intent was to have my own it's my understanding that other board members were going to show up to that
forum which would have violated the brown act so i want to make clear that i think that the original intent of this and my intent and wanting to do something separately as well was to sit around and just shoot the breeze on this and actually have a conversation i've been trying to take notes of the questions that have been put forth and
everyone's comments with the hopes of addressing those i would request though i know that it's not normally in our formal procedures to go back and forth with the audience but i do think that there was an intent and a spirit of this meeting and unfortunately um that was chipped away at by forcing a special meeting so i
would just request that if there's a way for us to be flexible and and take those questions that would be exceedingly helpful i also want to say something else too you got to make it clear this board was held at the school district they could have easily held it at the park all right so there was something going
on to have it here i completely agree there are probably about 100 people outside that probably more than that that were wanting to have a discussion without shouting without arguing but to hear what you guys have to say because these we're we're going to lose our jobs we're going to pull our kids from a school that we
love we're going to be walking away not walking away but we're going to be forced out of something that we truly have put our entire lives to and so we want to hear how you guys are supporting us because it doesn't feel especially right now at the school board meeting right here does not feel like you guys are listening to
us it feels like you're still silencing us and you're not listening to our questions even though you're writing them down i see that but we wanted to have a discussion and hear solutions that's that's what we all came here for and i i i think i can speak for most of the people here that that's what we came
here for is to have it to hear solutions from our district that's what we wanted what we're going to do is we are bound by certain processes procedures for this meeting right i will um and maybe we'll bring it i will bring it up during our discussion on the board up here if individual board members want to
meet with small groups then i will encourage that and you'll be able to sit down and have a dialogue with with those board members so there's no possible way to have tonight yeah not tonight what about in the future that's what i mean i'm asking that question that's what i just said with that during our discussion time
tonight on as a board but you said a small group so we want everybody heard excuse me can i have another point of order the reason that this forum was this embarked was that three of us could not meet i was willing to do something separately to respect the more collaborative process i am under the impression my colleagues
were not so if my colleagues can agree to host forums and only have two of us there at a time and respect the different forums and not show up so that we don't violate the brown act um i think we can accomplish that and i'd like to accomplish that um i think there's a way to do this but that means
that two of us like that means that three of us have to be willing to not show up when two of us are there hosting a forum so i think we need to express some collegiality and respect for all of you and agree to do that over the next couple of weeks and just respect that you know we we can't show up when
there's two of us because we simply and i don't i don't you know this is a weird construct like the legislature doesn't have this no other government bodies have this except for you know city councils and school boards and so i respect it it's frustrating it's frustrating to me i'm frankly tired of having these meetings where we're sitting here
looking like we're not being responsive because we're not having a conversation i completely agree but i would then ask all of my other colleagues that if we have these forums just respect that you can't attend all of them you know something we set the rules we're local we were elected by the community we could do practically anything we want
that's not true that is not accurate but that is not accurate because i don't think we were aware that we were supposed to come with questions you can still submit cards so we could submit so everybody here can submit a question and you will i think what would be more beneficial for you guys is to allow us to go through the process
tonight have a discussion up here and then afterwards we can contact you can contact individual board members to have meetings but i don't think that's an actual solution yeah i mean we only get three minutes and you guys get to sit and collaborate yeah or when we're on christmas break exactly so we're keeping something here it's just a little frustrating because
yeah let me talk for a second um i already have heard from somebody that the timing wasn't right even today's a meeting teachers would get off at 3 50 and unclassified employees get off at 4 30. so time is inaccurate for this meeting first place but i believe this is the uh kind of very first beginning of a conversation so
i would like to hear everything from you guys you have made your speaker cards and and speak your mind and then if we need enough time to prepare for this fight and war that we're going to win should we have another meeting in the future it should be after our work time so that more people could attend in a larger venue
and this is not only what you guys standing for is not what you're standing for yourself not just for your family but for this whole state so thank you thank you [Applause] molly large followed by kathy wogen followed by mary jane ashley as you've just discussed this is not the ideal format for this conversation there are many people that opted to
avoid this meeting to avoid this format because of concerns about respect and safety i was hoping to be part of a dialogue but i will do my best to share my perspective in the form of a monologue instead we clearly have a difference of opinion regarding what the right thing is to the governor the right thing is to
ensure that everyone who engages with our students is vaccinated and thus less likely to spread the infection to students to me as well the right thing is to do everything possible to protect our students that's why i'm vaccinated the argument that the mortality rate is low is not compelling to me any mortality rate is unacceptable and one that we should do everything in our
power to mitigate having lost friends and family members to covet that is an agony i would not wish on anyone i understand that there are people who have concerns about the vaccination who are concerned that has not been sufficiently studied and you think that job requirements that include a vaccine are unconstitutional but the people here who are opposed to
vaccine mandates are only a small part of this district though loud they do not represent the viewpoint of the majority i came here knowing that my comments would not be welcomed by this group i came here knowing that there are strong feelings that have led to disrespectful behavior and that i may be the target of that to prayer to paraphrase some prior
speakers please do everything in your power to support the health and safety of teachers staff and students in this district we say we care about kids prove it by doing everything you can to keep them safe good evening board members i'm dr enfield i'm a teacher in this district i've been a teacher in this district for over 20
years i've been teaching for over 30 years probably 35 36. um i wasn't planning to speak tonight however when we got here i thought it was going to be an open discussion like police before we were saying however i think it's important you understand that these vaccines are having consequences i did my due diligence i took my vaccine
and as of march 19 2021 i received the vaccine and since then i've had two emergency visits for many strokes many seizures i have been under a doctor's care i've seen multiple neurologists they still have not pinpointed my problem or how to diagnose it or even how to to service me i continue going and taking memory tests
and other things it has devastated my life i rarely drive more than two miles from my home my adult children pretty much spend most of their available time babysitting me because they're afraid to leave me alone now it has become a major problem in my family it has affected us greatly if you mandate this next vaccine i will
have to be forced to retire i asked my neurologist for a letter of exemption and this is what she said to me she said that there's been a 300 percent increase since the vaccines started for neurological problems she said the cdc is threatening to issue malpractice or lose their license or lose their funding for writing exemption letters
that's what i was told i asked her she put that in writing she said no because she could lose her license and she's in charge of a major funding study right now so she was not willing to do that my own personal doctor is not even treating me because the way that she would normally treat me and i asked her
if you had a daughter she goes oh wait i do have a daughter but she's not getting any vaccines that's great but meanwhile i've already had vaccines and now i can't even function some days um i've had to use a lot of my sick leave since taking these vaccines just to go to doctors appointments because now we
have late ending schools and i can't even get a doctor's appointment in the afternoons and if i do get a doctor's appointment it's usually nine to ten weeks out every single time i see the doctor so in between i'm taking tests and i'm worrying like crazy not sleeping and not doing well these vaccines i don't have a problem against vaccines
but they are not for everyone and my health my doctors originally told me that i should wait and see how people reacted and i didn't have that option because students were coming into my classroom the following monday so i took the vaccines as part of my job would i do it again no way so i'm asking you not only to vote
against these mandates which i believe personally are unconstitutional for god's sake and then the other thing is i'm asking you to pray for me because i don't know how this is going to end for me time [Applause] for you guys to discuss specifically okay thank you mary jane ashley [Music] yes my name is mary jane ashley do i have
three minutes to speak i guess okay so i'll speak fast i'm an employee over at don lugo high school in the agricultural department which was considered essential through the pandemics so we still work with a limited amount of our students we're still all here today this is a second career for me i spent 30 years in the pharmaceutical industry
so i'm familiar with dr faushi not okaying a drug for aids patients for upper and lower respiratory bathroom so he allowed thousands of patients to die while he was wanting to develop a vaccine for aids which he didn't get it accomplished so we have other therapeutic drugs available to us that dr fauci again is not okay for use
of covid i know myself i was had covid and i was using hydrochloroquine during that time and antibiotic i was pretty sick for about 30 days i never took any time off of school i actually took a judging team for a two or three day trip we all survived i've had students out for a week or so
they've all come back we seem to lose sight that we have like a 98 survival rate on this okay so if the vaccine eradicated covid then i could see us being mandated to take it but it doesn't so it's against our constitutional right to object for this vaccine you've had heard other people that have had adverse reactions to it my brother
has had cancer he was in remission for about four years doing good last minute he decided you know because of the news to take the vaccine his remission has failed now so um sorry because i wrote this really quick uh anyway uh iranton has or i'm sorry hydrochloroquine's been on the market for over 25 years they've had less than
400 adverse reactions to the drug it's been proven to be effective but fauci refuses to look at that data as well as the iremectin antiviral drug so i think you know i'm here to get answers like what do you guys want to do you know can we have a conversation i don't want to come up and say this this this you know
like you guys aren't having a part of this conversation but i will not let anybody strip away my rights and i will go down with a fight i love my job here i love the ag department i feel that the teachers the group of teachers that we have are an asset to this program and i'd love to stay
but i will not allow my rights to be stripped away from me [Applause] that's it okay we now move on to item two which is the discussion item up on the diocese item 202 discussion of the potential effects of a vaccine mandate for district employees recommend the board of education discuss the potential effects of a vaccine mandate for district
employees or members before we start the discussion uh i need a motion so moved second motioned by mr nasika by mrs garnier put the item on the floor board members i would remind you that this discussion is uh based on the one action or one discussion item only i don't know if mr cruz or mr naw was
first mr cruz was first okay go ahead mr cruz i just want to present some facts in africa less than two percent are vaccinated and they have the lowest in coverage infection i heard this on mainstream for the people who are not vaccinated it's safe and effective so take your shot for those who are vaccinated the vaccine
is waning does not prevent transmission therefore you have to take your booster 2020 cova deaths was 377 thousand and twenty twenty one coveted deaths is three hundred and eighty six thousand we have a survivor weight of ninety nine point nine nine nine nine nine five percent uh 113 firefighters were placed on leave without pay never let them break your will
when the board changes in november 2022 and it becomes the worst mr gnaw myself and the other new board members will reinstate you immediately with full back pay all of you so i have to admit it's going to say it's going to take i'm going to say some stuff that maybe doesn't make sense to you but it sure
makes sense to me you know you enjoy the process the process of being persecuted afflicted the stress and anxiety of the mental pain that a lot of you are going to experience or you have already experienced and this what happens you become stronger you become a hero you protect our children by modeling and you know what to do you forgive and
you don't hate that does not mean you don't go after them or attack them but we've got to stop the sacrifice of our child our of our children with his like 99.9995 survivor weight that gives us meaning and purpose in our lives and to the mothers you know the vaccinating of children that is the last straw it's no longer a matter of time
mothers are going to go fight and win and defend their children and she knew employees too thank you mr knox [Applause] i have heard one speaker saying what is your thoughts as a board member on this issue and i've been thinking many days and a lot of things we haven't faced this type of experience in the past
so we need to come up with forward and sometimes out-of-box solutions to protect our brothers and sisters and who you are our children don't care about our school board members being here not being here or even mr newsom they want their teachers they want their secretaries and staff members so we need you more than ourselves here so let's make
that let's make that clear i'd like to propose number one our district to declare state of emergency for district-wide shortage of workforce i think that should be step number one and second i'd like to have a district assist and accommodate and facilitate receiving exemption status for our employee groups that will be second and and third suggestion would be
requesting a letter of personal guarantee from mr newsom for safeness of this vaccine that he's trying to mandate any time we hire construction companies or or any of a group to come work on our school district guess what do we ask we ask for guarantee insurance responsibility same thing with auto insurance something should happen who's going to be accounted for
and we need to request the personal guarantee letter from mr newsome for any mandates that he wants to to place a bonus because he doesn't care or he wouldn't even know how great our teachers and staff might lose jobs for our children that will be very detrimental for our students they don't know about declining enrollment right the state
has very very low quality leadership very low quality i'm very very disappointed in them they're not qualified to be leaders the the decisions they have made are often short-sighted for instance i'm going a little bit offshore but we had a looting problem just recently 10 20 people would go in and they wouldn't go into small stores but
department stores to steal 50 tens of thousands of dollars of of goods in a daylight nighttime they didn't care so then our state says go arrest them hold them accountable and guess what those same people had passed the law in previous years so that as soon as they were cut they were released this is the type of leadership we are
facing so what are they know about our education our teachers and our staff members if we don't support you and we don't come together work together we're we're by ourselves if we follow a car that's in the wrong direction that's where we're gonna fail so just thank you for your con your presence here it's not just your fight
it's the state we need to keep our state alive and we need to take it back and and having our just common sense rights so again i would like to suggest that our district to declare save emergency for wide shortage of workforce so that tells how serious we are about this mandate thank you [Applause] mrs gone here do you have any comments
since uh you don't have a light system there uh yeah so just a couple of things um first and foremost uh thank you for all the questions i think one of the things that i've been hoping to get out of our meetings and again i don't think this is the best environment for that is concrete questions and concerns um
clearly with all things coveted related there is a spectrum of concerns and a spectrum of opinions and i in my belief it is clear on some of these matters what various opinions are i do think we really need to start drilling down to concrete concerns and things that we may or may not be able to resolve i know what i'm about to say is not
going to be popular but i am very sort of legal oriented and so i'm going to just sort of stick to what i know one of my concerns is that there is no mandate as of right now and when i say that it's that we've been living in a limbo for two months and a week with zero guidance
from either governor newsom or the california department of public health as to what he means with this mandate what i can ascertain from comments and from any publicly available statements and to be very clear there's no insider baseball that you know we have any line on as to what's going on with this we have the same information that any member of the
public has this is intended right now to be an administrative regulation so as i've been having conversations with with parents um as well as educators over their concerns i've tried to drill down into what is the precise concern because some of the messaging from some people is no mandate whatsoever which is they don't care what it looks like if
there's exemptions regardless there just should be no mandate at all other people are looking for medical exemptions they believe firmly that even if a mandate had a medical exemption because of current state law around student vaccinations and vaccine requirements that there wouldn't be meaningful exemptions in so far as as people go to their doctors and try to seek an
exemption doctors are sort of in this environment right now and they've been in the last couple of years where they're sort of afraid to give exemptions even for pre-existing vaccines because they're afraid of you know getting investigated or losing their license and unfortunately you know that that bill that came a couple years ago was a result of a couple of bad actors that
was not you know the practice overall for most doctors um others are looking for religious or personal exemptions and whether or not if that was actually included in a mandate whether or not that would be meaningful insofar as you know as a school district if that were to exist in a mandate um is the school district going to honor such a request
and so you know what i really want to drill down into is you know what the specific request is is it zero mandate whatsoever and i know that some people that's exactly their opinion and they're not going to shift from it is it if there is a mandate i want a medical or a personal religious exemption and i
firmly don't believe that even if in spirit you know that is a part of the regulation so for example if it's administrative regulation from the governor that's just not going to happen in practice and so i sort of throw that question back out which is probably not helpful since there's a litany of questions that have been thrown out but you know i i am
looking for we keep getting asked to do something um and i think i've made it clear that i i want to do things in in reaction to facts and information so if we had a mandate before us today and there were the 10 things that are happening under this mandate it would be a lot easier to articulate what we can
and cannot do within the bounds of the law to also respect our our employees so for example if it said there's going to be medical religious exemptions um you know i i personally have no problem with that i i think that those exemptions have gotten chipped away particularly medical exemptions i've heard from a lot of parents who are concerned who have
children with autoimmune and other disorders as well as educators who suffered the same thing that are concerned about the fact that generally they've been exempt from taking certain vaccines and now they may not be exempt from taking this one so you know i i hear those concerns what i'm trying to distill is is that the concern is the concern about
a mandate blanket mandate whatsoever is a concern about the fact that there's going to be no meaningful exemptions because i'm trying to articulate in my head a way that we can actually help as a board that will be meaningful i also want to address the fact that i believe one of the reasons why we don't have zero we have zero clarity excuse me
on the state mandate or the proposed state mandates i think it's important to remind everybody that we just don't have the letter of what the mandate is going to look like is there have been stays in federal court of the biden administrations as well as the osha requirements regarding vaccines and these have been stays which means that these mandates are pending review
i don't suppose to know what the fifth circuit is going to do what these other federal courts are going to do in regards to mandates but they have not made a decision they've stayed these mandates pending review so it may well be a month from now two months from now we hear from these federal courts that these mandates
are unconstitutional and if that's the case i'd presume to guess that the state of california is not going to do something unconstitutional so i'm trying to i i know that might seem funny but i don't think i'm not going to get into constitutional law but i don't presume the attorney general if you don't want to trust governor newsom i don't presume
attorney general banta is going to do something unconstitutional it makes no sense the state will get sued by the federal government so that that's what it will become or get sued by individual litigants and so either way uh this will end up in court and if it's unconstitutional the fifth circuit says it the ninth circuit will probably say
it will be unconstitutional that being said i i have no idea what's going to be in this mandate but i'd like to drill down on central concerns and ways we can help because you know if you want help liaising with local representatives our assembly members our members of congress if you're concerned about the federal mandate you know i
would like to craft a message that i think they will listen to and i've had many conversations with parents particularly where they're concerned that the political composition of our local elected leaders is not going to listen to their concerns and so my my point of view on this is if there's something particular that we can assist with
and say look our employees are looking for x i'd be happy to assist with that um it's my belief so personally not not as a board member not in any voting capacity that the message of no mandate whatsoever you know might fall on deaf ears and so i want to drill down to what is what are the core concerns with this
and how can we as local elected officials help liaise with those people that are making these decisions thank you mr bridge thank you i i kind of want to follow up a little bit with what uh ms gagne said because i was kind of thinking along the same lines i know we've heard conversation about more restrictive local policies such as la
san diego we don't have that here but being at a conference last week and hearing about and this is believing all over the map all over the state uh what is the potential liability for this district if we have a failure to enforce the mandates you know you know california department of public health uh local public health what's what's san
bernardino county say and and i'd like to probably direct a question to dr enfield and mr ride out with what if you could uh in our conversation tonight explain a little bit about what locally what san bernardino county is requiring and what you're hearing from the state as far as these mandates as far as as far as positions
with what the concern with these employees are and our teachers and employees as to how they um you know how are we going to be able to respond to that i know i'm not making very much sense or being very clear as i'd like to be but what kind of grievances are going to be brought up and then the one thing that
really stuck with me last week is either way they're going to be lawsuits either way i heard you know people mention it i've heard lawsuits coming from the other side as well so and and also what's the availability of insurance coverage for claims if uh if if someone who is not not vaccinated and then and then contracts it at school
is there going to be a problem with our insurance with our insurance carriers there's all kinds of questions all over the you know all over the map and so just second second i'm just throwing this stuff i'm just throwing this i'm just throwing this stuff out that no come on now give me a break you know what
you got to think of these things there's just there's there's two sides and there's people as you heard that are on the other side of this issue as well that we're also hearing from that that you necessarily don't hear from unless you hear from it at school so those are just things that uh i would like to just uh in part as part of our
conversation because whatever whatever we can do we're going to have to respond to what was being done not only from the california department of public health but also san bernardino county not riverside county not la county even though many of us can throw a rock and hit l.a county from our homes but other than that that's what we're going to have to go by
so with that i'll conclude my comments mr cruz did you have comments yes so you're hearing you're hearing the feeling okay you're hearing the sense of you know you gotta have to be proactive and get ready you're seeing many districts out there january 1st january 18th they're going to mandate kids and teachers and staff five-year-olds they started already
they're going to start with babies in january and february i see new york falling apart australia with its camps los angeles a basket case which may have been before germany australia new zealand canada your gut tells you that this is more than just a just a covet it's much more deeper than than you could possibly imagine but like
i'm going to restate this again as the board changes in november 20 22 we're going to restate you immediately with full back pay okay and what you need to do you just got to be proactive and get ready for whatever worse comes but you got to put that in your mind because i don't see this going away this
is not going away okay they're pushing the boosters knowing the fact that this is waning and it's not working but yet they're pushing the boosters and they're telling you guys to take the vaccine knowing the fact that it doesn't work but you have to take the booster in about six months from now so you're gonna have an issue with
right now it's the unvaccinated in about a year from now it's gonna be the booster folks i mean it's america's gonna crash and burn okay so so you just have to plan and prepare yourself for the worst because i foresee the worst okay there's there's some questions i want to say and um and we like to put this in public
and this is one this is one that i'm concerned in in june really does a vaccine requirement need to be agreed to at the bargaining table as with other parts of the employment contract or can the district unilaterally require it by claiming an emergency measure you know i don't know if they're going to force in chino during the second
semester but i'm really concerned in june that this may be embedded in our contract where you have to be vaccinated or you can't you can't sign your contract but that's something that you have to put in the back your mind on that another question are personal religious exemptions on the table is it something the district will consider in order to maintain it's once
called heroes workforce that's number two how will the interactive these are these came from people how will the interactive process for accommodations be carried out for employees with medical exemptions which accommodations will be considered the last one is employees have successfully argued against being docked leave if they retest and provide a negative for covid results after getting a false positive from the
company test kit the district uses are employees going to have to fight this battle each time or is it now a protocol to docked employees and there's also another thing too you got to be i think all of us have to be advocates for our own health i'm going to tell you something what i did i i i don't see nothing wrong with
me personally this is what i did about a year ago you know i submit a lot of chino champion newspapers like four of them because i i saw the writing on the wall i saw it and so once they talked about ivermectum you know what i did i got sick and i got some horse paste and i took some and
i was fine i had to be an advocate for my my own self for the mere fact that these hospitals were like putting tubes down their throat without even providing any treatment before and so many people died because the treatment was so outrageous they were not willing to provide everything possible to help these people so we're going to be our own advocate
hydroquinone queen ivermectum vitamin d vitamin c once and you know something i honestly feel that this stuff is good for the flu too so i say you you grab all the stuff and and um you get ready you get ready because let me tell you i you ever heard the dark winter that biden was talking about well john hopkins that they had a
scenario in 2001 called dark winter and and you know it's really candy that they they bring up that word dark dark winter and then john hopkins has this thing called dark winter and it's about smallpox and and one excerpt talks about kids getting sick so let me tell you the worst thing i could see this dark winter is kids
and why are they getting sick the vaccine and it's it's kind of nerve-wracking and then you've got something called sparse pandemic created in 2016 it's so canning of what's happening now you just read that and it's following the play what's happening right now sparse and that's made from john hopkins too i mean they think we're so stupid
but unfortunately a lot of us are sleeping mr nah yeah i'm just questioning myself because i thought my expectation for this meeting was about brainstorming all together and find ways to protect our teachers and staffs from forced mandates which could cause jobs which cause loss for our students i think that's about this meeting yeah so let's get to the point
so some people can give you half an hour of excuses or or or sidetracks so that you can get lost and then their answer will be still no i don't care okay so if you guys are over 18 years old be focused and pay attention um we don't have earthquakes every month in southern california thank god for that
that's it so should mandate don't happen or be nullified will be still fine but should mandate will be enforced then what are we going to do well it's a month too late no that's the reason why you guys just showed up here so let's get to the point let's make it clear to our board members and our staffs
the reason why we're here and and look at our job description to protect and honor all of our employees who's been vaccinated and also who has not been vaccinated for the real reasons we need to come together and brainstorm look at what other districts are doing what other entities are doing what kind of legal help that we need to prepare
and i think that's going to be a meeting that they won't waste our time we could have been preparing for dinner or been watching tv for now if we just hear excuses and excuses thank you i will just say this real quick mr nahad you abided by the brown act we could have had a dialogue or mr bridge and i
would have had a dialogue with the teachers tonight that was the original intention of this meeting we had to change it to this format so that we weren't violation of the brown act okay i will go off of the list of uh some questions that were submitted first it says when will small group meetings begin uh as soon as you contact the
board member um to find out their availability and and meet with the board member if it's your site if it's a group of teachers from different sites however you want to set that up if you contact the individual board members and set up a time to meet with them then we won't have an issue with brown act violations okay so
you guys figure out in your small groups or combine a couple of groups however you want to set it up just know that no we can only have a maximum of two board members at those meetings to participate okay that's just the way the california law is the next is had a question to do with court decisions
it's kind of a double-edged sword um the court decisions that you guys mentioned tonight are all outside of california their appellate courts federal appellate courts those usually only applied to the district which that appellate court has jurisdiction over we're the ninth district i don't think the ninth district has heard a case yet and unfortunately the closest ones we
have which is why i say it's a double edge is the case is out of against the firefighters union in los angeles um so we want to be very careful as to saying are we going to follow court orders and court decisions because they're not all favorable and so we need to kind of parse through those look i'm going to be the first to
tell you we don't have all the answers i know you guys are looking for answers and trust me i wish we had them to give to you but until we know what the actual mandate's going to look like what the requirements are going to be what exemptions are going to be accepted and how that process is going to go because
i'm hoping and i assume that the exemption process is different for the adults as it is for our students because the ones for students are very tight and so hopefully the exemption process for the adults within the educational system is different so those are things that we're waiting to see and see what happens i i don't want to sit up here and
hypothesize on what we can and can't do and what we will and won't do until we know what we're looking at because i you have to remember the other thing is mr bridge said there's going to be lawsuits either way and we have to look out also part of this is the financial well-being of this district so that we can all continue
hopefully to work and get paid so that's that's one of the things that we're looking at so i will go back to the courts number one and then number two again the small meetings or however whatever size you want please contact individual board meeting members or two board members for their availability and have a location site possibly in mind
and i think that i can speak for my colleagues that we will make ourselves as available as possible to to meet with employees to try to discuss this and come up with some solutions because like i said we don't have all the answers i think i covered exemptions a little bit because we don't know what the exemptions are going to look like
and so until we know what we're talking about um i'm in favor of accepting whatever exemptions are possible but again that comes from the state as to when they put out the mandates what the exemptions might look like mr knight you have a yes i have a comment yeah i i don't see why we need to meet in our small groups
individually privately it's out already spoken all our group wants to hear is what our board members gonna do and our staff is gonna do to protect our teachers and staff it's it's not a long grocery list it's not it's just simple and [Applause] just say yes or no are we going to protect our employees vaccinated on vaccines say yes
if we said oh yes then let's go protect them we don't know what the future is look like okay then we can guesstimate from very good news to the worst news so we can prepare if there's a good news we don't have to do anything just in case if there's a very bad news how far we gonna go to protect our
our teachers and our staff for our children's sake that's all this is not a math problem this is simple but it's a real problem that we're facing and we're all people and when we say we are family members we need to be acting like one yeah so i'm sure you're in many of our parents is a heart
they support you uh 100 so i'm going to continue to push for declaration of state of emergency for district-wide shortage of our workforce i think that will be the beginning that will be the beginning so letting everybody know we're very serious about our teachers and staff members and and yes finance do matter what about the declining student enrollments what about those
cancelled for civil classes what about a lacking education because of a shortage of a workforce so that all entitles to to to finance california spends so much money on education but guess what house are ranking 49th 48th that's terrible so money isn't the problem it's the people and we need you thank you so i asked this question earlier um and
frankly i i can't get a pulse on what people's opinions is so you can feel free to contact me but um i'm not for a sit and wait thing so if the concern is there's going to be no meaningful exemptions then what is the district's strategy to tackle that so i have made an offer if that is the concern to go to
earth that's not everybody's opinion though some people are fond of having like exceptions folks please let her finish your comments thank you look look i i'll be i'll be frank about the state of state politics here and you know this is just is what it is but our local elected officials can make this mandate a legislative mandate right
now it's proposed as an administrative mandate with exemptions they may well go back up to sacramento in january and do that they're in district right now if there are articulable concerns that you're not going to walk into some of these people's offices and say no mandate whatsoever but they will hear we don't we want exemptions and we want
meaningful exemptions and this is why we want them and then that might happen and then there are those exemptions and you will not have to get a vaccine so i'm trying to problem solve here about what we can go i've had people ask me can you go to our local electeds and and take our concerns i just don't believe i'm
happy to take this message to them but i think there's a more nuanced there's a just like with there's a spectrum across covid on all things covid there's a spectrum of people that don't want to get vaccinated and so i've heard from different groups and so there are some people who they just want the exemptions and if
those exemptions are personal and religious and medical then by virtue of having all three of those they'll be actionable so if you don't want a vaccine you don't have to get a vaccine that's probably going to be something that's more received by our local and other elected officials in california then no mandate whatsoever i i'm just saying that because i if you
want us to be helpful now as this mandate is being fashioned like i'm trying to offer a way to be helpful uh i'm also listening to all the concerns if it gets past but you know i think there's a couple balls in the air right now and i'm not listing a whole laundry list of things or anything else like i i'm happy to go
talk to our four local electeds in the state senate and assembly and take all these concerns to them but i think like if there's an ask at the end of that meeting i'd like to have an ask that i think they're actually going to say i'd be willing to go that way and i'd be willing to convince my
colleagues in other parts of the state to also go that way so there's actual exemptions so that's all that i'm asking i don't want to sit around for two months and then let everybody go back to sacramento and do things and not have communicated anything so i'm making a genuine offer to take some of the things that you said today
and go talk to our local officials on both sides of the aisle and our federal officials even because there's a federal mandate also in play that's been saved and try to communicate to them what the concerns here are locally and i really don't think that's going to fall on deaf ears but i do think that if it's just no
absolute no without some nuance to it that like that that might not be received i'm just communicating look i'm just communicating what what i perceive to be from previous votes and previous actions are elected officials what they may or may not do if we're trying to prevent them from doing the worst case scenario that's what i'm trying to accomplish here so
if you want to reach out to me i've taken notes today i've taken questions i'm happy to meet in person i'm happy to liaise with these people but i also like to be proactive i don't want to depend on the courts and i don't want to depend on hoping that our elected officials not hearing anything you know just sort of know
what's happening in our meetings because they don't so that's where i'm coming from is like i'm trying to be helpful in a way that i think would be productive proactively which is to tell these people we need these things and these are the consequences of not having these things and i think that because this vaccine is so new there is a likelihood that there
would be this you know list of exemptions and those of you that do not want to get vaccines would not have to get vaccinated so i i that that's where i'm coming from here is if we're actually going to try to get these people to listen and do what you want them to do what's the best way to do
that mr cruz or the vaccine so you could take your okay ma'am this is the board's time to discuss this please mr cruz do you have mr cruz do you have comments thank you so we can give her numbers of how many people find and meet with her well you guys wouldn't allow this kind of conduct in your classroom so i don't
know why it's appropriate in the boardroom okay in turn mr cruz please like i said you know you all have to be proactive i mean in the same boat as you guys um this california is very black so i don't think nothing's not going to so like i said really put this back in your mind when war changes november 2022
you're restating immediately you remember that because that would be the worst also you know what president schaefer stated about the meeting meeting was at the school district it would have been just a dialogue between those two people but they wanted a meeting they should have had it someplace else not within the school side because it would have
been very strange having both of them and then nobody would then the site so and you know that that i don't think have never heard that has never happened before since 2012 having a meeting at the school site with only two board members i don't recall something like that ever happening you could convene your own meeting what's that
