Boundaries for Cal Aero Preserve Academy and Preserve School #2

The board approved Scenario No. 1 as the attendance boundaries for Cal Aero Preserve Academy and Preserve School #2, on a motion by James Na seconded by Andrew Cruz. 1 No one asked to speak on the item, and no board member commented before the vote. 2 2

The staff memo traces the process from a February 2 presentation through boundary committee meetings and a survey of Cal Aero parents and guardians to four scenarios shown to the board on May 4. The committee's objectives were to cut Cal Aero's enrollment (1,354 daily, 1,691 total) to a manageable level, remove portable classrooms to reclaim playground space, and balance the two schools. Fifty-four percent of survey respondents chose Scenario No. 1, and 80 percent of committee members recommended it. 3 The packet's map for Scenario No. 1 projects 952 K-8 students at Cal Aero Preserve Academy in 2024/25 against a capacity of 900, and 818 at Preserve School #2 against a capacity of 925. 3

Immediately before that item, President Shaw opened and closed a public hearing on the naming of Preserve School #2 at 7:11 p.m.; there were no comments. 1 The hearing was a step in the naming process the board began on April 6 under Board Policy 7310: a 30-day public window for suggested names from April 7, this hearing, and action planned for June 1. 4 5 The name came later than that plan: the June 15, 2023 minutes record Legacy Academy as the name of Preserve School #2. 6

Other action items

• Allegiance STEAM Academy, Thrive. The board approved the amended facilities memorandum of understanding with the charter school for 2023/2024, on a motion by Na seconded by Cruz. 7 The memo describes it as the Proposition 39 agreement for the charter's use of the former El Rancho ES site, approved by the charter's board on April 28, with a district oversight fee of 3 percent of the charter's revenue plus monthly utility costs over a five-year term. 8
• Declaration of Need. The board approved the Declaration of Need for Fully Qualified Educators for 2023/2024, on a motion by Na seconded by Jon Monroe. 1 The memo explains the declaration must be filed with the Commission on Teacher Credentialing each year before July 1 for the district to keep using the emergency permits still available. 9
• Closed session. The board met in closed session from 3:55 to 5:45 p.m. 10 It appointed Sangeeta Morar as Coordinator, MTSS-B, Health Services, effective July 1, 2023. 7

Consent calendar

The board approved the consent items on a motion by Na seconded by Cruz. 1 Among them:

• Administration building contracts. The board awarded Bid No. 22-23-22F, administration relocations at Anna Borba, Marshall and Walnut elementary schools, to 16 contractors. 11 The memo describes the work as new administrative office buildings, at a cost of $10,759,160 to Measure G Building Fund 21. 12
• Legal services. The board approved payment for legal services to the law office of Tao Rossini, APC. 1 The memo gives a December invoice of $35,022.50 and a table of the district's law firms with year-to-date totals. 13
• Storm-day attendance. The board approved the request for allowance of attendance due to emergency conditions. 1 The memo lists dates from January 4 through March 21, 2023 when attendance fell, which it ties to the winter storms, and gives the fiscal effect as avoiding the loss of 45 ADA. 13
• Policies. The board approved revisions to Board Bylaw 9124, Legal Services, and Board Policy 6158, Independent Study. 1 1 The bylaw was updated to CSBA recommended language 14 15, and the independent study policy to reflect Assembly Bill 181. 16
• Other items. The board approved change orders and completion notices for Chino HS reconstruction packages, adopted a resolution to buy through a piggyback contract, rejected a claim and referred it to the district's insurance adjuster, and approved a revised affiliation agreement with Pacific College of Nursing, which the memo says renames the college Pacific College and spells out the parties' and students' responsibilities in more detail. 11 11 17 The board also approved student admission, readmission and expulsion cases. 1

For information, the board received a new AP Physics C: Electricity and Magnetism course and revisions to policies 6172.1 and 6178. 11

Military salute, a world title, and staff honors

President Shaw and the board honored students enlisting in the U.S. military, and the Chino Young Marines led the pledge. 7 The honorees read out included an appointment to the U.S. Military Academy at West Point. 18 The board also recognized Ayala HS and Chino Hills HS for taking first and second place in the Percussion Scholastic World category at the 2023 Winter Guard International championships. 7 A speaker for Ayala's program said 53 students (as captioned) made the trip to Dayton, Ohio. 19 FloMarching's report on the championships gave Ayala's winning score as 97.938, its first gold medal since 2016. 20

Outgoing student representative Maya King acknowledged the accomplishments of the class of 2023. 7 Brenda Walker, A.C.T. president, announced A.C.T. scholarship recipients and retirees, and named Rosio Rodriguez, a special education teacher at Hidden Trails ES, as A.C.T. Elementary Teacher of the Year and Julianne Dougherty as Nurse of the Year. 7 Danny Hernandez, CSEA president, said the union's car show in the district office parking lot raised scholarship money, spoke about classified evaluations, and named school secretaries CSEA's 2023 Unsung Heroes, with Kylene Valles accepting for them. 7 On evaluations, he said forms had not gone out during COVID and some administrators now seemed to expect perfection. 21 21 Barbara Bearden, CHAMP president, congratulated Karen Morales on retiring after 31 years at Walnut ES, and Kyle Schuler, principal of Buena Vista HS, and his team on its recognition as a model continuation high school. 7

Public comment

The minutes list three speakers on items not on the agenda: Melissa Compani announced community events sponsored by Curt Hagman, Fourth District Supervisor; Misty spoke regarding being cyberbullied by a group opposed to her freedom of speech; and Virginia Renteria spoke regarding books. 7 The minutes record each speaker's subject but not what was said.

The minutes record two board members responding in their closing comments. James Na asked Superintendent Enfield to have the Director of Risk Management speak to the parent who addressed the board about cyberbullying, and Andrew Cruz encouraged Misty to continue to speak her truth. 22

Board communications

• Don Bridge thanked Maya King, congratulated the enlistees and Ayala's percussion program, and reported on events including band showcases and a Chino Hills Parks and Recreation Commission meeting, where he spoke about interest in the Teen Advisory Board. 23 He said it drew 61 applications (as captioned), with interviews from around June 5. 24
• James Na thanked Maya King and acknowledged her mother, attended the theatre arts program at Don Lugo HS, called the district's music program stellar, and made the risk management request above. 22
• Andrew Cruz spoke about concerns raised with him about school wellness centers, parental rights, legislation involving wellness clinics and AB 665, other bills that could affect districts, and vaccines, and said policy is the key to safety in children's lives. 22 He described AB 665 as letting a treating professional decide that involving a minor's parents would be inappropriate, and asked the board to look further so parents stay in charge. 25 25 25 Other bills he listed, as captioned, concerned police dogs, school resource officers, tobacco suspensions and menstrual products in elementary grades. 26 26 26 AB 665 was signed in October 2023 and took effect July 1, 2024. 27
• Jon Monroe thanked Maya King, Brenda Walker and Danny Hernandez, called the music programs a legacy, said he would miss the next meeting, and, after a visit to the Nixon Library, reflected on a quote from President Nixon 22: "we cannot learn from one another until we stop shouting at one another." 28
• Superintendent Norm Enfield thanked Maya King and recognized the graduating seniors. 22
• President Sonja Shaw thanked Maya King and her parents, listed school events she attended, and announced that girls' flag football is coming to the district's high schools next year. 22 She urged parents to follow state bills and contact legislators, said that while in Washington, D.C., U.S. Health and Human Services Secretary Becerra encouraged board members to take his money and let him put clinics on campuses, and spoke about AB 1078 as an attempt to take away local control. 29 She described AB 1078 as requiring districts to get State Board of Education approval before removing library books or curriculum, and said it was being amended because people were speaking up. 30 30 The bill Governor Newsom signed on September 25, 2023 dropped that approval requirement. 31
