Chino Valley's board meets in closed session on the parental-notification case it directed staff to appeal, would close out the Don Lugo gym lobby with about $1.4 million in unused allowances credited back, and hears the Measure G oversight report
🔎 Preview: the October 15, 2026 Board of Education meeting
This page previews a meeting that has not happened yet, written from the agenda and its packet. Nothing on it has been decided. Closed session is set for 4:25 p.m. and the regular meeting for 6:00 p.m. 1
The board on the agenda is John Cervantes, Andrew Cruz, James Na, Sonja Shaw and Shaun Smith, with Malia Ngo as student representative and Norm Enfield as superintendent 1. There are no action items this time: everything up for a vote sits on the consent calendar, and the policy item is for information only 2 3.
1. ⚖️ Closed session: the parental-notification case and five other legal matters
The closed-session list holds six litigation items, three expulsion cases, two appointments, a discipline/dismissal/release item and the superintendent's performance evaluation 1. The regular session at 6:00 p.m. opens with a report of any closed-session action 2.
The state's case over the 2023 policy. One existing-litigation item is San Bernardino County Superior Court Case No. CIVSB2317301, listed with the California Justice Center and Advocates for Faith & Freedom 1. A September 2023 agenda item for a legal-services contract identifies that case as The People of the State of California, Ex Rel. et al -v- Chino Valley Unified School District 4. EdSource reported on September 16, 2026 that Judge Michael Sachs had declined the district's request to dissolve his injunction against the 2023 policy, which required staff to tell parents within three days when a student asked to use a different name or pronoun. The district had argued that the U.S. Supreme Court's emergency ruling in Mirabelli v. Bonta affirmed parents' right to be informed, and its attorney, Emily Rae of the California Justice Center, said it was too soon to say whether the district would appeal, according to EdSource 5.
The draft minutes of the September 17 meeting, held the next day and now on this agenda for approval, report that the board came out of closed session having directed the superintendent, in consultation with legal counsel, to appeal the court's decision in that case 3. The recording of that meeting carries the same announcement 6.
The federal case. Also listed is federal Case No. 2:24-cv-01941, with the Liberty Justice Center 1. Clearinghouse records that number as Chino Valley Unified School District v. Newsom, the district's challenge to AB 1955 filed in July 2024; the district court dismissed it in 2025, and its docket lists an appeal at the Ninth Circuit 7.
The rest of the list: an anticipated-litigation item with Advocates for Faith & Freedom, two Public Employment Relations Board cases brought by the Associated Chino Teachers, and one more existing case with Atkinson, Andelson, Loya, Ruud & Romo 1. One of the two appointments is the principal of a multi-track year-round K-8 school, a job whose new description was on the September 17 agenda 1 8.
2. 🏀 Don Lugo's gym lobby would close out with about $1.4 million in unused allowances credited back
Fifteen consent items ask the board to approve a change order and notice of completion for each bid package of the Don Lugo HS New Gym Lobby 9 10. The May 15, 2025 minutes list 15 contractors for the project 11. The bid memo described the work as a new lobby connecting to the existing gym, plus new gym flooring and courtyard and site work 12.
Every one of the 15 change orders is a deduction. They run from $40,048 on the Exclusive Metal package 13 to $282,259 on the Southern California West Coast Electric package 14. Added together, the packet's figures take $1,398,067 off $10,417,734 in original bid amounts, for revised totals of $9,019,667 (our arithmetic from the 15 memos) 15 16. The memos date completion of the work to June 26 or July 31, 2026 15 16. The scanned change-order forms behind them give the same reason each time: "Credit back the unused contract allowances." 15 16
3. 🎭 A portable-classroom package under the Ayala arts center bid
Another consent item would close the first bid package under the Ayala HS Performing Arts Center bid, which its change-order form ties to a Legacy Academy 9 portable classroom addition 17: a $46,568 change order on a $1,966,800 package held by Disabled Veteran Modular Buildings, Inc., for a revised $2,013,368, with work completed September 30, 2026 17. The form shows $48,944 to replace damaged siding on the portables, less $2,376 in unused allowances 17. The May 7, 2026 minutes list that firm first among the center's contractors 18. The Champion reported in May that the $43.6 million center is funded with Measure G bond money and that completion is expected in late 2028 19.
4. 🏗️ The Measure G oversight committee reports
The evening's one presentation is the annual report of the Measure G Citizens' Oversight Committee for 2025/2026 2. The packet does not include the report. Measure G is the $750 million school bond that won 55.99% of the vote on November 8, 2016, according to the district 20. At last year's report, the September 18, 2025 minutes record committee member Art Bennett saying the committee met four times in 2024/2025, the financial and performance audits showed no discrepancies or non-compliance, and $623.2 million had been spent with $109.9 million remaining 21.
5. 🐀 Pest control, and a vendor with recent history
Staff recommend five vendors for a new gopher and pest control request for proposals: Agricultural Pest Control, EarlyBird Extermination, Inc., Integrated Pest Control Management, Inc., Go-Pher The Kill, Inc., and Pest Options, Inc. The memo weights cost at 50% and gives the fiscal impact only as "Per Proposal Sheet" 22. Separately, the September 17 agenda listed a $27,068 payment to Pest Options "under threat of potential litigation or disputed claim," after work staff scheduled under a 2025 agreement exceeded the bid limit and the county superintendent's office would not process the payments 23.
6. 📡 Verizon's antenna amendment comes back
The Fourth Amendment to the 2004 land lease that put Verizon Wireless antennas on a Chino Hills HS stadium light standard returns after being pulled from the September 17 agenda, according to that meeting's draft minutes 24. It would allow further antenna modifications under state architect review, with Verizon reimbursing the district's inspection costs and paying a one-time $7,500 fee 17 25. The Third Amendment to the same lease appears among the May 21, 2026 consent actions 26.
7. 📋 Complaint procedures rewrite (information only)
A memo prepared by Deputy Superintendent Grace Park presents revisions to Board Policy and Administrative Regulation 1312.3, Uniform Complaint Procedures, to reflect the programs and timelines in state regulations 27. The policy redline adds complaints about school plans for student achievement and school site councils 28, and accommodations for pregnant and parenting students 29. In the regulation, struck text that gave the compliance officer ten business days to begin an investigation is dropped, and new text in the investigation section says the district will complete the investigation and a written decision within 60 calendar days of receiving the complaint 30; the existing timeline section already sends the report within 60 calendar days 31. The redline also strikes language that let the respondent in a discrimination, harassment, intimidation or bullying complaint file a complaint with the board if dissatisfied with the decision 31. The current policy was last revised May 15, 2025 32.
Also on the agenda
Recognitions go to Ayala HS's girls varsity cross country team, Ayala's engineering pathway for an eSchool News publication, and the Chino Valley Fire District for AED and trauma kit donations 2. The consent calendar also carries the September 17 minutes 2; $49,867.44 in August legal bills from three firms, bringing the three firms' 2026/2027 year-to-date total to $159,434.09 33; three student expulsions 34; the state preschool continued funding application 35; a piggyback on a state contract with Beynon Sports Surfaces 36; five small construction projects totaling $99,028.68 37; contractor agreements, including an amendment raising a Zonar Systems transportation software contract from $450,000 to $554,084.40 38; personnel items; and rejection of a $6,650.95 claim for vehicle damage blamed on an unsecured gate at Rhodes ES 39. The quarterly Williams report lists no complaints for July through September 27.
