February 3, 2022: Board Picks a Later Bell Schedule and a New Trustee Map as COVID-19 Mandates Dominate Public Comment

President Christina Gagnier called the meeting to order at 5:00 p.m. with Don Bridge, Andrew Cruz, James Na, Joe Schaffer and Gagnier present in the quad area at Buena Vista Continuation High School 1. The board chose new school start times under SB 328, tabled a resolution on that law for a rewrite, and adopted new trustee-area boundaries 2. ⏰ New school start times under SB 328

SB 328, approved October 13, 2019, requires junior high schools to start no earlier than 8:00 a.m. and high schools no earlier than 8:30 a.m., with new times taking effect July 1, 2022 4. A task force built options over three meetings, each keeping 45 minutes between elementary and secondary bells for busing, and a survey ran January 14 to 28 4.

Staff told the board the task force had recommended Option C 5. Families overall ranked Option E first and Option A second; employees overall put A and E at the top 66.

The minutes record that Sonjia Shaw, Casandra Sanchez, and Kristi Hirst addressed the board on the item (names as printed) but not what each said 2. The Champion quoted Shaw, a task force member and president of Parent Advocacy for Chino Valley, warning of "a big giant mess because we don't have enough bus drivers" 7.

Decision: On a motion by Schaffer, seconded by Bridge, the board selected Option E: elementary 7:50 a.m. to 2:30 p.m., junior high 9:12 a.m. to 3:15 p.m., high school 8:35 a.m. to 3:22 p.m. The minutes record that Cruz and Na abstained and the student representative voted yes 2. The Champion reported Na's explanation: he would not support "the very low-quality office holders in Sacramento" who voted for SB 328 7. The new times took effect that August, the Champion reported 8.

📜 SB 328 resolution sent back for a rewrite

Gagnier submitted Resolution 2021/2022-59 9, asking the Legislature to let districts delay SB 328 until at least the 2024/2025 school year 10. Bridge moved it for discussion and Cruz seconded. Then, on a motion by Gagnier seconded by Na, the board tabled it to February 17, to be revised to ask that SB 328 be rescinded rather than delayed 2. On February 17 the board adopted the revised resolution 11.

🗺️ New trustee-area boundaries

State law requires trustee areas to be rebalanced after each census; the district's first by-trustee map was chosen at its August 19, 2021 meeting 12, and three draft plans were posted on December 17, 2021 12.

Gagnier opened the public hearing at 7:39 p.m. Jim Gallagher spoke in favor of Scenario 1, no one else spoke, and the hearing closed at 7:42 p.m. 2

• Scenario 3 was moved by Schaffer and seconded by Bridge. It failed; the minutes record that Bridge, Cruz and Na voted no 2.
• Scenario 1 was moved by Bridge and seconded by Gagnier, and the board selected it. The minutes record that Schaffer voted no and the student representative voted yes 2.
• Resolution 2021/2022-53, approving the adjusted boundaries, was adopted on a motion by Bridge, seconded by Na. The minutes record that Schaffer voted no 2.

The Champion reported that the map put Schaffer and Bridge in one district and Cruz and Na in another and created two open districts, and quoted Bridge: "It's the unfortunate thing about district voting." 13

🔒 Closed session and consent calendar

The board met in closed session from 5:00 to 5:38 p.m. on anticipated litigation, a student discipline matter, a student readmission and assistant principal appointments 1. It reported appointing Patricia Vega-Jeter as assistant principal of Cal Aero K-8, effective February 4, 2022 2.

The consent calendar was approved as amended (correcting three contract dates) on a motion by Na, seconded by Schaffer 142. It included:

• a revision of Bylaw 9320 adding rules for teleconferenced meetings during a declared emergency under AB 361 1415;
• legal-services payments to Atkinson, Andelson, Loya, Ruud & Romo; Margaret A. Chidester & Associates; and Tao Rossini, APC 14, for December invoices totaling $51,092.42 16;
• a resolution supporting Assembly Bill 75, a state school facilities bond 17, which the Champion described as a $12 billion state measure 18; the staff report said district projects could draw about $100 million in state matching funds 19;
• an agreement with the City of Chino and a resolution on police access to the district's security cameras 17. The Champion reported that police could view them in emergencies and after-hours incidents without district authorization but needed permission otherwise 20;
• a new job description for Coordinator, Equity, Diversity, and Support Systems 17.

Bella Avila, Parent Advocacy of Chino Valley, Sonia Singh (on behalf of Assemblyman Kevin Kiley), Kelly Allen, Cindy Foisy, Christie Salazar, Byron Gonzalez, Julie Santorsola, Heather Peery, Nichole Vicario, Casandra Sanchez, Alice Rodriguez, and Kristal addressed mandates associated with COVID-19, including masks and discrimination. Jim Gallagher spoke about Board Bylaw 9323, and Bernadette Mendez about the lack of a permanent classroom teacher for her son 2. Sonjia Shaw, Angela Romero, and Adam Hoover spoke later in opposition to COVID-19 mandates 3. The minutes record subjects, not remarks, so comments heard on the recording are not summarized here.

The Champion reported that Parent Advocacy for Chino Valley parents approached the podium together to tell the board "the line has been drawn," and that hundreds of students went to school without masks in a protest that began the next day 21. At the next meeting, on February 17, the board turned down a proposal to weaken the mask rules, ABC7 reported 22.

👥 Employee and student representatives

Student representative Esther Kim led the Pledge of Allegiance, spoke about student issues and career paths, and acknowledged senior student athletes 2.

A.C.T. President Brenda Walker thanked members who took the SB 328 survey, said the change originated at the state level, said the district would keep following state, county and local guidelines on testing all educators for COVID-19, and asked for an A.C.T. seat at the table in writing the LCAP 2. On the recording she added that those guidelines did not then include testing fully vaccinated people 23.

CHAMP President Barbara Bearden spoke about potential counselors, thanked staff who helped interview them, and announced a CHAMP Zoom meeting 2.

💬 Board communications

Schaffer thanked the SB 328 Task Force and asked Superintendent Enfield for the RFP timeline for vendors that could provide the services in the district's City of Chino contracts, which the board was to consider that summer 3. The City of Chino wording was added when these minutes were approved on February 17 11.

Bridge thanked the SB 328 committee, spoke about National Signing Day and recognizing student athletes 3. On the recording he said he was disappointed that no Chino schools appeared in the newspaper's signing-day coverage 24.

Cruz spoke about masks harming students' emotional well-being, read a parent email asking for masking choice, and spoke about what he described as masking's harm to IQ and oxygen levels, which this page does not evaluate. He said he would submit a resolution at the next meeting on mandated COVID-19 vaccines for students 3. His Resolution 2021/2022-63, on parent choice regarding student COVID-19 vaccination requirements 25, was adopted on February 17 11.

Na said he would bring a resolution prohibiting discipline of students for not wearing masks or not being vaccinated, and said a recent study showed masks prevent only 2% of spread, which this page does not evaluate. He said staff sent home during contact tracing were using their own sick leave, asked Enfield to work with union leadership, and urged viewers to join the Parent Advocacy Group 3. His February 17 item, "Positive Learning Environment for Students" 25, failed 11.

Enfield acknowledged school counselors, thanked the SB 328 Task Force, and said the district was working with CSEA and A.C.T. on COVID sick-time provisions 3.

With the board's consensus, the student representative spoke again, about students being involved as stakeholders 3. On the recording she floated lowering the voting age to 16 or 17 for school board elections only 2626.

Gagnier spoke about board meetings, community involvement and her role as president in running them 3. On the recording she said she would not shut meetings down as other districts had, calling that a violation of First Amendment rights 27, and that she wanted orderly meetings in which every member on the dais is recognized at the appropriate time 27.
