Heroism Recognition and School Year Opening

The meeting opened with recognition of two Chino Hills High School security officers. During fourth period on the first day of school, Trinity Lizzarago and Matthew Patuano responded to a medical emergency involving an unconscious, non-breathing student; Patuano took control of the scene while Lizzarago performed CPR and chest compressions using training the pair had completed just before the school year began. 1 Their action saved the student's life, and the board formally recognized both officers as an agenda presentation item. 2 Lizzarago was also honored as a CVUSD graduate herself, having come up through the district from preschool through Don Lugo High School. 1 CSEA President Danny Hernandez, speaking during the Comments from Employee Representatives item, added further recognition of Lizzarago, noting that her mother, Yvette Bookout, has served the district for 23 years. 23 In the same item, A.C.T. President Brenda Walker thanked staff for a strong start to the school year and spoke about ongoing successor-contract negotiations 2, and CHAMP President Barbara Bearden gave an overview of CHAMP's role and announced the return of in-person back-to-school nights for the first time since 2019. 10

Measure G Facilities Bond Progress

Kevin Cisneroz, chair of the Measure G Citizens Oversight Committee, presented the committee's 2021/2022 Annual Report. 24 As of June 30, 2022, the district had received three bond issuances totaling $606.5 million, earned $13.07 million in interest, and spent $410.78 million, leaving a $208.79 million balance. 5 Projects in progress during the 2021/2022 school year included the reconstruction of Chino High School, modernization at Ayala High School, Butterfield Ranch and Hidden Trails elementary schools, Canyon Hills and Townsend junior highs, and a district-wide safety and security project. 46

Developer Fee Increase

The board held a public hearing and adopted Resolution 2022/2023-07 increasing statutory Level 1 developer fees on new residential and commercial/industrial construction. 67 The State Allocation Board had raised the statewide fee caps in February 2022 — residential by $0.71 to $4.79 per square foot, commercial/industrial by $0.12 to $0.78 per square foot — and the district's consultant, Koppel & Gruber Public Finance, prepared the required School Fee Justification Study. 6 The increase takes effect 60 days after adoption, on October 17, 2022. 6 There were no speakers at the hearing, and student representative Maya King cast a yes vote on the resolution. 7

Instructional Materials Sufficiency Hearing

The board also adopted Resolution 2022/2023-11, certifying that sufficient standards-aligned textbooks and instructional materials had been provided to every student, including English learners, at Cal Aero Preserve Academy K-6 for 2022/2023. 89 Materials reviewed spanned English/Language Arts, math, history/social science, and science across grade bands. 9 There were no speakers, and the hearing closed without objection. 10

Curriculum and Policy Approvals

The board approved the Master Plan for Multilingual Programs 2022/2023, which frames English Learner instruction and guides the district's new Dual Language Immersion Mandarin program. 1112 It also approved revisions to Board Policy 6020 (Parent Involvement) 13 and Board Policy 6174 (Education for English Learners) 14 to reflect updated federal and state requirements, and adopted multi-year student attendance calendars for Cal Aero Preserve Academy and for Boys Republic HS, Chino Valley Learning Academy, and Chino Valley Adult School. 151612

Extra Duty Appointments Deferred

Board Member Joe Schaffer pulled certificated/classified personnel items from the consent calendar, asking that extra duty assignments be deferred to the September 1, 2022 meeting because he had received information about one position that he felt needed further vetting before approval. 1718 Andrew Cruz and James Na both objected, arguing that site administrators already vet these assignments and that the deferral second-guessed a process the board doesn't normally intervene in. 1920 Don Bridge, seconding the motion, noted that deferral would not affect pay, since stipend positions are paid only after the assignment or season is complete. 21 The motion to approve all personnel items except extra duty assignments passed over Cruz's and Na's opposition. 22

Student Expulsion Cases

The board separately considered two expulsion cases pulled from consent. It approved Case 22/23-02; a motion to approve Case 22/23-01 did not pass, with Cruz, Na, and President Gagnier opposed. 2324

Public Comment: Construction, Curriculum, Special Education, and Bullying

Six residents addressed the board on items not on the agenda. 25

Sharon Duran raised concerns about construction-related traffic and vehicle backups at Chino High School during student drop-off, which she said was contributing to tardies, and asked for greater oversight of construction timing; she also asked the board to recognize a longtime Chino High and Adult School teacher. 26

Donna Martinez questioned the addition of a gender-identity question to a student "getting to know you" survey. 27

Richard Wales raised the open-ended nature of a March 2020 emergency-authority resolution that gave the superintendent broad COVID-19 response powers without a specified end date, and asked about the status of a required self-audit of the Extended Learning Opportunities grant. 28

Darice De Guzman criticized the district's hiring of a special education coordinator whose past employment included a costly judgment against another district, and described chronic turnover and delayed responses from special education staff, including a two-month delay that cost her son a spot on a psychologist waitlist. 29

Sonja Shaw thanked security staff and asked the board to form a parent committee for special education, citing a pilot program at Magnolia Junior High as a model. 30

Summer Bibb described her eight-year-old son's bullying at a previous school and said the district required an attendance contract before re-enrolling him despite the underlying issue being bullying rather than parental neglect. 31

Board Communications

Joe Schaffer re-acknowledged Lizzarago and Patuano for saving a student's life, welcomed the new school year, and said he was looking forward to the fall sports season. 3234

Don Bridge welcomed student representative Maya King to the board, described touring the new Chino High School's biotech academy and other facilities at its grand opening, praised the Measure G bond program's reach across every campus, and noted he had attended a Chino Hills City Council meeting honoring the Chino Hills High School girls' water polo CIF championship team. 3235

Andrew Cruz returned to the case of the mother whose eight-year-old son had addressed the board earlier that evening, asking staff to look into her situation, and endorsed the idea of forming parent committees more broadly. 3236 He also asked Richard Wales to email his concerns directly to Superintendent Enfield, and — citing pending state legislation on minors' consent to vaccines and gender-related medical care — argued that parents, not the state, should retain authority over their children's decisions. 3237

James Na asked Dr. Enfield to follow up with the special education parent who had spoken during public comment, thanked the Don Lugo High School students in attendance, said he agreed with Sonja Shaw's call for a special education parent committee, and urged students toward bullying awareness and "servant leadership." 3238

Superintendent Enfield welcomed Maya King to the board, said the school year had opened smoothly, and thanked CSEA staff for preparing campuses over the summer along with the district's A.C.T. and CHAMP members. 3339

President Gagnier thanked the Measure G committee for the response to the new Chino High School campus, highlighted the upcoming launch of the district's Mandarin Dual Language Immersion program, and welcomed everyone — including Maya King — back for the new school year, before adjourning the open session at 7:44 p.m. to return to closed session. 3340

Closed Session Appointments and Adjournment

Returning from closed session at 7:57 p.m., the board reported four administrative appointments: Renae McCain as assistant principal at Eagle Canyon Elementary, effective August 19, 2022; Nicholas Frescas as assistant principal at Briggs K-8, effective date to be determined; and Craig Bartholio and Sarita Lopez as Special Education Coordinators, both effective August 19, 2022. 33 (The board's own transcript rendered these names phonetically as "Renee McCain" and "Nicolas Frescus" — the minutes' signed spellings, McCain and Frescas, are treated as authoritative here.) 41 No other closed-session business required public disclosure, and President Gagnier adjourned the regular meeting at 7:58 p.m. 3342 The minutes were signed by Christina Gagnier, President, and James Na, Clerk, and recorded by Patricia Kaylor, Administrative Secretary to the Board of Education. 33

The board also approved/ratified the warrant register, fundraising and donation items, and payment for legal services 7; approved the purchase order register and several contractor agreements, notices of completion, and change orders for Ayala High School construction, and awarded a bid for the school's pool and equipment 2243; rejected two insurance claims and approved an internship agreement with the Riverside County Office of Education and a student fieldwork agreement with the University of St. Augustine 2244; and received the San Bernardino County Superintendent's Williams Findings Fourth Quarterly Report for information. 3245
